1An Act to amend 20.155 (3) (r), 49.45 (23) (a), 49.471 (4) (a) 4. b., 196.504 (1) (a)
23. and 196.504 (2) (a); and
to create 49.471 (1) (cr) and 49.471 (4g) of the
3statutes;
relating to: eligible applicants under the broadband expansion grant
4program, funding for the program, Medicaid expansion, eligibility for
5BadgerCare Plus and BadgerCare Plus Core, and making an appropriation.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

Broadband expansion grants. From the universal service fund,
9as a continuing appropriation, the amounts in the schedule for broadband expansion
10grants under s. 196.504. All moneys transferred under
2015 Wisconsin Act 55,

9236 (1v) and all moneys transferred under 2015 Wisconsin Act .... (this act),
12section (8) (3) shall be credited to this appropriation account.

(23) (a) The department shall request a waiver from the secretary of the
3federal department of health and human services to permit the department to
4conduct a demonstration project to provide health care coverage to adults who are
5under the age of 65, who have family incomes not to exceed
100 133 percent of the
6poverty line
before application of the 5 percent income disregard under 42 CFR
7435.603 (d) except as provided in s. 49.471 (4g), and who are not otherwise eligible
8for medical assistance under this subchapter, the Badger Care health care program
9under s. 49.665, or Medicare under
42 USC 1395 et seq.

(4g) Medicaid expansion; federal medical assistance percentage. (a)
19For services provided to individuals described under sub. (4) (a) 4. and s. 49.45 (23),
20the department shall comply with all federal requirements to qualify for the highest
21available enhanced federal medical assistance percentage. The department shall
22submit any amendment to the state medical assistance plan, request for a waiver of
23federal Medicaid law, or other approval required by the federal government to
24provide services to the individuals described under sub. (4) (a) 4. and s. 49.45 (23) and
25qualify for the highest available enhanced federal medical assistance percentage.

1(b) If the department does not qualify for an enhanced federal medical
2assistance percentage, or if the enhanced federal medical assistance percentage
3obtained by the department is lower than printed in federal law as of July 1, 2013,
4for individuals eligible under sub. (4) (a) 4. or s. 49.45 (23), the department shall
5submit to the joint committee on finance a fiscal analysis comparing the cost to
6maintain coverage for adults who are not pregnant and not elderly at up to 133
7percent of the poverty line to the cost of limiting eligibility to those adults with family
8incomes up to 100 percent of the poverty line. The department may reduce income
9eligibility for adults who are not pregnant and not elderly from up to 133 percent of
10the poverty line to up to 100 percent of the poverty line only if this reduction in income
11eligibility levels is approved by the joint committee on finance.

(2) (a) To make broadband expansion grants to eligible applicants for
19the purpose of constructing broadband infrastructure in underserved areas
20designated under par. (d). Grants awarded under this section shall be paid from the
21appropriation under s. 20.155 (3) (r).
In each fiscal year, the total amount of the
22grants may not exceed $1,500,000.

25the statutes for the appropriation to the public service commission under section
120.155 (3) (r) of the statutes, as affected by the acts of 2015, the dollar amount for
2fiscal year 2015-16 is increased by $22,978,367 for the purpose for which the
3appropriation is made.

5universal service fund $22,978,367 in fiscal year 2015-16.

Medicaid expansion. In the schedule under section 20.005 (3) of the statutes
10for the appropriation to the department of health services under section 20.435 (4)
11(b) of the statutes, as affected by the acts of 2015, the dollar amount for fiscal year
122015-16 is decreased by $102,900,000 to provide Medical Assistance to certain
13adults with incomes up to 133 percent of the federal poverty line. In the schedule
14under section 20.005 (3) of the statutes for the appropriation to the department of
15health services under section 20.435 (4) (b) of the statutes, as affected by the acts of
162015, the dollar amount for fiscal year 2016-17 is decreased by $220,600,000 to
17provide Medical Assistance to certain adults with incomes up to 133 percent of the
18federal poverty line.

Effective dates. This act takes effect on the day after publication,
20except as follows:

The treatment of sections 49.45 (23) (a) and 49.471 (1) (cr), (4) (a) 4. b., and
22(4g) takes effect on March 1, 2016, or on the day after publication, whichever is later.
