1An Act to amend 20.292 (1) (d), 49.45 (23) (a) and 49.471 (4) (a) 4. b.; and
to
2create 49.471 (1) (cr) and 49.471 (4g) of the statutes;
relating to: state aid to
3technical colleges, Wisconsin grants for technical college students, Medicaid
4expansion, eligibility for BadgerCare Plus and BadgerCare Plus Core, and
5making appropriations.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1. 20.292 (1) (d) of the statutes is amended to read:

State aid for technical colleges; statewide guide. The As a
8continuing appropriation, the amounts in the schedule for state aids for technical
9college districts and technical colleges, including area schools and programs
10established and maintained under the supervision of the board, under s. 38.28 (2) (b),
11(be), and (bm), and for production and distribution of the statewide guide under s.
138.04 (18). Of the amount in the schedule for each fiscal year not exceeding $50,000
2may be spent by the board to match federal funds made available for technical
3education by any act of congress for the purposes set forth in such act and no more
4than $125,000 may be spent by the board to produce and distribute the statewide
5guide under s. 38.04 (18). If, in any fiscal year, actual program fees raised under s.
638.24 (1m) exceed board estimates, the increase shall be used to offset actual district
7aidable cost.

2. 49.45 (23) (a) of the statutes is amended to read:

(23) (a) The department shall request a waiver from the secretary of the
10federal department of health and human services to permit the department to
11conduct a demonstration project to provide health care coverage to adults who are
12under the age of 65, who have family incomes not to exceed
100 133 percent of the
13poverty line
before application of the 5 percent income disregard under 42 CFR
14435.603 (d), except as provided in s. 49.471 (4g), and who are not otherwise eligible
15for medical assistance under this subchapter, the Badger Care health care program
16under s. 49.665, or Medicare under
42 USC 1395 et seq.

(4g) Medicaid expansion; federal medical assistance percentage. (a)
2For services provided to individuals described under sub. (4) (a) 4. and s. 49.45 (23),
3the department shall comply with all federal requirements to qualify for the highest
4available enhanced federal medical assistance percentage. The department shall
5submit any amendment to the state medical assistance plan, request for a waiver of
6federal Medicaid law, or other approval required by the federal government to
7provide services to the individuals described under sub. (4) (a) 4. and s. 49.45 (23) and
8qualify for the highest available enhanced federal medical assistance percentage.

(b) If the department does not qualify for an enhanced federal medical
10assistance percentage, or if the enhanced federal medical assistance percentage
11obtained by the department is lower than printed in federal law as of July 1, 2013,
12for individuals eligible under sub. (4) (a) 4. or s. 49.45 (23), the department shall
13submit to the joint committee on finance a fiscal analysis comparing the cost to
14maintain coverage for adults who are not pregnant and not elderly at up to 133
15percent of the poverty line to the cost of limiting eligibility to those adults with family
16incomes up to 100 percent of the poverty line. The department may reduce income
17eligibility for adults who are not pregnant and not elderly from up to 133 percent of
18the poverty line to up to 100 percent of the poverty line only if this reduction in income
19eligibility levels is approved by the joint committee on finance.

State aid to technical colleges. In the schedule under section 20.005 (3)
22of the statutes for the appropriation to the technical college system board under
23section 20.292 (1) (d) of the statutes, as affected by the acts of 2015, the dollar amount
24for fiscal year 2015-16 is increased by $203,000 for the purpose for which the
25appropriation is made.

Wisconsin grants to technical college students. In the schedule under
2section 20.005 (3) of the statutes for the appropriation to the higher educational aids
3board under section 20.235 (1) (ff) of the statutes, as affected by the acts of 2015, the
4dollar amount for fiscal year 2015-16 is increased by $5,000,000 and the dollar
5amount for fiscal year 2016-17 is increased by $5,000,000, for the purpose for which
6the appropriation is made.

Medical Assistance. In the schedule under section 20.005 (3) of the statutes
8for the appropriation to the department of health services under section 20.435 (4)
9(b) of the statutes, as affected by the acts of 2015, the dollar amount for fiscal year
102015-16 is decreased by $102,900,000 to provide Medical Assistance to certain
11adults with incomes up to 133 percent of the federal poverty line. In the schedule
12under section 20.005 (3) of the statutes for the appropriation to the department of
13health services under section 20.435 (4) (b) of the statutes, as affected by the acts of
142015, the dollar amount for fiscal year 2016-17 is decreased by $220,600,000 to
15provide Medical Assistance to certain adults with incomes up to 133 percent of the
16federal poverty line.

7.
Effective dates. This act takes effect on the day after publication,
18except as follows:

19(1) The treatment of sections 49.45 (23) (a) and 49.471 (1) (cr), (4) (a) 4. b., and
20(4g) of the statutes takes effect on March 1, 2016, or on the day after publication,
21whichever is later.
