ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 123

AB123-AA1,1,1 At the locations indicated, amend the bill as follows:

AB123-AA1,1,3 1. Page 1, line 11: after “appraisals," insert “rights-of-way for telecommunications service,".

AB123-AA1,1,4 2. Page 4, line 6: delete lines 6 to 14 and substitute:

AB123-AA1,1,5 “ Section 2m. 16.994 (2) of the statutes is amended to read:

AB123-AA1,1,8 16.994 (2) Eligible school districts. A school district is eligible for a grant under this section if the school district's membership in the previous school year divided by the school district's area in square miles is 13 16 or less.”.

AB123-AA1,1,10 3. Page 7, line 2: delete the material beginning with “Notwithstanding" and ending with “s. 20.155 (3) (r)." on line 4.

AB123-AA1,2,2 4. Page 7, line 17: delete the material beginning with “Notwithstanding" and ending with “20.155 (3) (r)." on line 19 and substitute “ Notwithstanding s. 20.001 (3) (b), the unencumbered balance on June 30 of each odd-numbered year shall be transferred to the appropriation account under s. 20.155 (3) (r).”.

AB123-AA1,2,4 6. Page 8, line 11: after that line insert:

AB123-AA1,2,6 “ Section 18g. 24.40 (1) of the statutes is renumbered 24.40 (1r) and amended to read:

AB123-AA1,2,13 24.40 (1r) Every board, commission, department and agency of the state having real estate belonging to the state under its control may grant easements in said property for public utility or telecommunications service through, over, under, along or to said property, including without limitation by enumeration the necessary poles, wires, structures, lines, fiber, conduits, pipes or pipe lines for heat, light, water, gas, sewer, power, telecommunications service, telegraph and transmission of messages.

AB123-AA1,18r Section 18r. 24.40 (1g) of the statutes is created to read:

AB123-AA1,2,16 24.40 (1g) In this section, “telecommunications service” has the meaning given in s. 182.017 (1g) (cq).”.

AB123-AA1,2,17 7. Page 8, line 17: delete “secure" and substitute “grant".

AB123-AA1,2,18 8. Page 9, line 14: after that line insert:

AB123-AA1,2,19 “ Section 20m. 86.16 (1) of the statutes is amended to read:

AB123-AA1,3,4 86.16 (1) Any person, firm, or corporation, including any foreign corporation authorized to transact business in this state, may, subject to ss. 30.44 (3m), 30.45 and 196.491 (3) (d) 3m., with the written consent of the department with respect to state trunk highways, and with the written consent of local authorities with respect to highways under their jurisdiction, including connecting highways, construct and operate lines, wires, or fiber for telecommunications service, as defined in s. 182.017 (1g) (cq), telegraph, telephone, or electric lines, or pipes or pipelines, for the purpose of transmitting voice, video, data, messages, water, liquid manure, heat, light, or power along, across, under, or within the limits of the highway.”.

AB123-AA1,3,6 9. Page 11, line 10: delete “high-speed, switched, broadband" and substitute “advanced".

AB123-AA1,3,7 10. Page 12, line 23: delete “July 1, 2017," and substitute “October 15, 2017,".

AB123-AA1,3,8 11. Page 13, line 13: delete lines 13 to 18 and substitute:

AB123-AA1,3,11 “(b) A school district is eligible for a grant under this subsection if the school district's membership in the previous school year divided by the school district's area in square miles is 16 or less.”.

AB123-AA1,3,12 12. Page 14, line 19: after that line insert:

AB123-AA1,3,15 “(5) Notwithstanding s. 20.001 (3) (b) of the statutes, the unencumbered balance in the appropriation account under section 20.505 (4) (s) of the statutes shall be retained in the appropriation account at the end of the 2015-17 biennium.

AB123-AA1,3,19 (6) In the schedule under 20.005 (3) of the statutes for the appropriation to the department of administration under section 20.505 (4) (s) of the statutes, the dollar amount for fiscal year 2017-18 is increased by the unencumbered balance retained under subsection (5).”.
