(c) If a FoodShare recipient requests a 4th replacement benefit card in a
512-month period, the department shall issue the card and send the recipient a notice
6informing the recipient of all of the following:

71. That the FoodShare recipient has reached the threshold for the number of
8replacement cards that is determined to be excessive in a 12-month period.

92. That, if the FoodShare recipient requests another replacement card in the
10same 12-month period, the recipient's benefit case will be referred to the office of the
11inspector general for review for possible misuse in connection with the recipient's
12benefit card.

133. Any other information required by the department.

1(d) If a FoodShare recipient requests a 5th replacement benefit card in a
212-month period, the department shall do all of the following as applicable:

31. Send the FoodShare recipient a notice that the recipient has exceeded the
4number of replacement benefit cards that is determined to be excessive, that the case
5is being reviewed by the office of the inspector general for possible misuse in
6connection with the recipient's benefit card, and that the recipient must contact the
7department to provide an explanation for the need for the replacement card.

82. If, after receiving the notice under subdivision 1., the recipient does not
9contact the department to provide an explanation for the need for the replacement
10card, decline to issue the replacement card.

113. If, after receiving the notice under subdivision 1., the recipient contacts the
12department, regardless whether he or she provides an explanation for the need for
13the replacement card, issue the replacement card.

144. If a recipient who contacts the department under subdivision 3. refuses to
15provide an explanation for the need for the replacement card or provides an
16explanation that appears to indicate trafficking of benefits, refer the case to the office
17of the inspector general for an investigation.”.
