ASSEMBLY AMENDMENT 4, TO ASSEMBLY BILL 331

AB331-AA4,1,1 At the locations indicated, amend the bill as follows:

AB331-AA4,1,2 1. Page 1, line 5: after “crimes" insert “and making an appropriation".

AB331-AA4,1,3 2. Page 2, line 1: before that line insert:

AB331-AA4,1,4 “ Section 1d. 20.455 (2) (hk) of the statutes is created to read:

AB331-AA4,1,7 20.455 (2) (hk) Expungement of records. All moneys received under s. 973.015 (1m) (a) 1. b. for programmatic changes and maintenance of a system for redacting expunged court records.”.

AB331-AA4,1,9 3. Page 2, line 10: after “973.015" insert “on or after the effective date of this paragraph .... [LRB inserts date],".

AB331-AA4,2,2 4. Page 2, line 11: after “request." insert “Any person whose record was expunged under s. 973.015 before the effective date of this paragraph .... [LRB inserts date], may submit a written request to the department in the manner determined by the department and the department shall redact the record after the department confirms the order of expungement.".

AB331-AA4,2,4 5. Page 3, line 17: delete “When the person has" and substitute “If at least one year has passed since the person".

AB331-AA4,2,5 6. Page 4, line 2: delete “subsequent" and substitute “2nd".

AB331-AA4,2,6 7. Page 4, line 3: delete “previous" and substitute “first".

AB331-AA4,2,12 8. Page 4, line 4: after “petition." insert “No person may file more than 2 petitions per record under this subd. 1. b. For a 2nd petition regarding the same record, the person shall pay to the clerk of circuit court a $100 fee. Of the fees received by the clerk, the county treasurer shall pay 50 percent to the secretary of administration for deposit in the general fund. The secretary of administration shall credit the money received to the appropriation account under s. 20.455 (2) (hk).”.

AB331-AA4,2,16 9. Page 5, line 24: before “The department" insert “For each record ordered expunged under this section, the clerk of circuit court ordering the expungement shall notify the department of justice of the expungement order in the manner determined by the department of justice.".

AB331-AA4,2,17 10. Page 6, line 11: after that line insert:

AB331-AA4,2,18 “ Section 11n. Effective date.

AB331-AA4,2,20 (1) This act takes effect on the first day of the 7th month beginning after publication.”.
