ASSEMBLY AMENDMENT 11, TO ASSEMBLY SUBSTITUTE AMENDMENT 1, TO ASSEMBLY BILL 348

AB348-ASA1-AA11,1,1 At the locations indicated, amend the substitute amendment as follows:

AB348-ASA1-AA11,1,2 1. Page 13, line 8: delete lines 8 to 15 and substitute:

AB348-ASA1-AA11,1,4 “(f) Damage and repair; construction accommodation. 1. The state or a political subdivision may do any of the following:

AB348-ASA1-AA11,1,8 a. Require a wireless provider to repair all damage that is directly caused by the activities of the wireless provider in a right-of-way involving its wireless facilities, wireless support structures, or utility poles, and to return the right-of-way to its former condition before it was so damaged.

AB348-ASA1-AA11,1,12 b. Require a wireless provider to move its wireless facilities, wireless support structures, or utility poles that are located in a right-of-way as the state or political subdivision determines is necessary to accommodate street widening and other street construction projects.

AB348-ASA1-AA11,2,5 2. If the wireless provider fails to make repairs or movements required under subd. 1. within a reasonable amount of time after receiving a written request by the state or a political subdivision, the state or political subdivision may make the necessary repairs or movements and charge the liable party for the cost of the repairs or movements.”.
