1An Act to amend 146.40 (3); and
to create 20.292 (1) (em) and 38.04 (33) of the
2statutes;
relating to: hours of instructional program for nurse aides, grants to
3technical college districts for nurse aide training, and making an appropriation.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
5the following amounts for the purposes indicated:

(33) Nurse aide training. (a) In this subsection, “nurse aide” has the
5meaning given in s. 146.40 (1) (d).

(b) From the appropriation under s. 20.292 (1) (em), the board shall award
7grants to district boards in areas with nurse aide shortages to expand access to nurse
8aide training.

. 146.40 (3) of the statutes is amended to read:

(3) Except as provided in sub. (4d), the department shall approve
11instructional programs for nurse aides that apply for, and satisfy standards for,
12approval that are promulgated by rule by the department.
The department may not
13require an instructional program to exceed the federal required minimum total
14training hours or minimum hours of supervised practical training under 42 CFR
15483.152 (a). The department shall review the curriculum of each approved
16instructional program at least once every 24 months following the date of approval
17to determine whether the program continues to satisfy the standards for approval.
18Under this subsection, the department may, after providing notice, suspend or
19revoke the approval of an instructional program or impose a plan of correction on the
20program if the program fails to satisfy the standards for approval or operates under
21conditions that are other than those contained in the application approved by the
22department.
