Investigational drug, device, and biological product assistance
3program. Biennially, the amounts in the schedule for assisting lower income persons
4to afford investigational drug, device, and biological product costs under s. 49.689.

649.689 Investigational drug, device, and biological product assistance
7program. (1) In this section, “investigational drug, device, or biological product”
8has the meaning given in s. 450.135 (1) (b).

9(2) From the appropriation under s. 20.435 (4) (bx), the department shall pay
10the costs of an investigational drug, device, or biological product for an individual
11who is eligible under sub. (3).

12(3) An individual is eligible to receive the payment specified under sub. (2) if
13he or she meets all of the following criteria:

(a) He or she has residence in this state.

(b) He or she is an eligible patient, as defined in s. 450.135 (1) (a).

(c) He or she is an individual whose annual gross household income is at or
17below 250 percent of the poverty line.

18(4) The department shall determine the eligibility of individuals applying for
19payment of costs under this section and establish a schedule of payment based on the
20ability of individuals to pay.”.

1(1) The treatment of sections 20.435 (4) (bx) and 49.689 of the statutes takes
2effect on the day after publication, or on the 2nd day after publication of the 2017
3biennial budget act, whichever is later.”.
