AB192-ASA1,1,3 1An Act to amend 49.45 (29y) (a) (intro.); and to create 49.45 (29y) (am) of the
2statutes; relating to: mental health clinical consultations under the Medical
3Assistance program and making an appropriation.
Analysis by the Legislative Reference Bureau
Current law requires the Department of Health Services to reimburse clinical
consultations for students who are under 21 years of age under the Medical
Assistance program. Clinical consultations are communications from a mental
health professional or qualified treatment trainee to another individual to inform,
inquire, and instruct on the symptoms, strategies for care and intervention, and
treatment expectations for the student and to direct and coordinate clinical service
components. This bill adds communications to a parent of the student as
reimbursable clinical consultations. The bill defines “parent” as a parent, foster
parent, guardian, or a relative who lives with the student and is other than a parent.
2019 Wisconsin Act 9, the biennial budget act, eliminated the June 30, 2019,
termination date on the clinical consultation reimbursement.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 49.45 (29y) (a) (intro.) of the statutes is amended to read:
AB192-ASA1,2,72 49.45 (29y) (a) (intro.) In this subsection, “clinical consultation" means, for a
3student up to age 21, communication from a mental health professional or a qualified
4treatment trainee working under the supervision of a mental health professional to
5another individual who is working with the client or to a parent of the student to
6inform, inquire, and instruct regarding all of the following and to direct and
7coordinate clinical service components:

AB192-ASA1,2,99 49.45 (29y) (am) In this subsection, “parent” means any of the following:

AB192-ASA1,2,1212 3. A guardian.
AB192-ASA1,2,1313 4. A relative, other than a parent, who lives with the student.

AB192-ASA1,2,2215 (1) Mental health clinical consultations. In the schedule under s. 20.005 (3)
16for the appropriation to the department of health services under s. 20.435 (4) (b), the
17dollar amount for fiscal year 2019-20 is increased by $75,600 for reimbursements for
18mental health clinical consultations under the Medical Assistance program. In the
19schedule under s. 20.005 (3) for the appropriation to the department of health
20services under s. 20.435 (4) (b), the dollar amount for fiscal year 2020-21 is increased
21by $75,600 for reimbursements for mental health clinical consultations under the
22Medical Assistance program.
