SENATE SUBSTITUTE AMENDMENT 1,
TO SENATE JOINT RESOLUTION 101

SJR101-SSA1,1,4 1To create section 7 of article III of the constitution; relating to: prohibiting state
2and local governments from using privately sourced moneys or equipment in
3connection with the conduct of elections and specifying who may perform tasks
4related to the conduct of an election (first consideration).
Analysis by the Legislative Reference Bureau
This constitutional amendment, proposed to the 2021 legislature on first
consideration, provides that no state agency or officer or employee in state
government and no political subdivision of the state or officer or employee of a
political subdivision may apply for, accept, expend, or use any moneys or equipment
in connection with the conduct of any primary, election, or referendum if the moneys
or equipment are donated or granted by an individual or nongovernmental entity.
The constitutional amendment also prohibits any individual other than an election
official designated by law from performing any task in the conduct of any primary,
election, or referendum.
A constitutional amendment requires adoption by two successive legislatures
and ratification by the people before it can become effective.

1Section 1. Section 7 of article III of the constitution is created to read:
SJR101-SSA1,2,62 [Article III] Section 7 (1) No state agency or officer or employee in state
3government and no political subdivision of the state or officer or employee of a
4political subdivision may apply for, accept, expend, or use any moneys or equipment
5in connection with the conduct of any primary, election, or referendum if the moneys
6or equipment are donated or granted by an individual or nongovernmental entity.
SJR101-SSA1,2,87 (2) No individual other than an election official designated by law may perform
8any task in the conduct of any primary, election, or referendum.
SJR101-SSA1,2 9Section 2. Numbering of new provision. If another constitutional
10amendment ratified by the people creates the number of any provision created in this
11joint resolution, the chief of the legislative reference bureau shall determine the
12sequencing and the numbering of the provisions whose numbers conflict.
SJR101-SSA1,2,15 13Be it further resolved, That this proposed amendment be referred to the
14legislature to be chosen at the next general election and that it be published for three
15months previous to the time of holding such election.
