AB395-ASA1,5,16 15344.581 Peer-to-peer motor vehicle sharing. (1) Definitions. In this
16section:
AB395-ASA1,5,1817 (a) “Motor vehicle sharing agreement” has the meaning given in s. 632.362 (1)
18(b).
AB395-ASA1,5,1919 (b) “Motor vehicle sharing duration” has the meaning given in s. 632.362 (1) (d).
AB395-ASA1,5,2120 (c) “Peer-to-peer motor vehicle sharing program” has the meaning given in s.
21632.362 (1) (g).
AB395-ASA1,5,2222 (d) “Shared vehicle driver” has the meaning given in s. 632.362 (1) (h).
AB395-ASA1,5,2423 (e) Notwithstanding s. 344.01 (2) (cm), “shared vehicle owner” has the meaning
24given in s. 632.362 (1) (i).
AB395-ASA1,6,4
1(2) Operator's license required. A peer-to-peer motor vehicle sharing
2program may not enter into a motor vehicle sharing agreement with an individual
3who will operate a shared motor vehicle unless the individual has attained the age
4of 18 and satisfies any of the following:
AB395-ASA1,6,65 (a) The individual holds an operator's license under ch. 343 that authorizes the
6individual to operate a motor vehicle of the class of the shared motor vehicle.
AB395-ASA1,6,107 (b) The individual is a nonresident of this state who holds a license issued by
8the state or country of the individual's residence that authorizes the individual to
9operate a motor vehicle of the class of the shared motor vehicle in that state or
10country.
AB395-ASA1,6,20 11(3) Responsibility for certain equipment. A peer-to-peer motor vehicle
12sharing program has sole responsibility for any equipment, including a global
13positioning system or other special equipment, that is put in or on a motor vehicle
14to monitor or facilitate the motor vehicle sharing transaction. The peer-to-peer
15motor vehicle sharing program shall agree to indemnify and hold harmless the
16shared vehicle owner for any damage to or theft of equipment described under this
17subsection during the motor vehicle sharing duration that is not caused by the
18shared vehicle owner. The peer-to-peer motor vehicle sharing program has the right
19to seek indemnity from the shared vehicle driver for any loss or damage to equipment
20described under this subsection during the motor vehicle sharing duration.
AB395-ASA1,6,24 21(4) Safety recalls. (a) At the time a motor vehicle owner registers as a shared
22vehicle owner through a peer-to-peer motor vehicle sharing program and before the
23shared vehicle owner makes a motor vehicle available for sharing, the peer-to-peer
24motor vehicle sharing program shall do all of the following:

11. Verify that the shared motor vehicle is not the subject of a safety recall for
2which the repairs have not been made.
AB395-ASA1,7,43 2. Notify the shared vehicle owner of the shared vehicle owner's responsibilities
4under par. (b).
AB395-ASA1,7,65 (b) A shared vehicle owner that receives notice of a safety recall on the shared
6motor vehicle shall do all of the following, as applicable:
AB395-ASA1,7,87 1. Refrain from making the motor vehicle available for sharing until the safety
8recall repair has been made.
AB395-ASA1,7,129 2. If the motor vehicle has been made available for sharing before receipt of the
10notice of recall, remove the motor vehicle from the peer-to-peer motor vehicle
11sharing program as soon as practicable after receipt of the notice and until the safety
12recall repair has been made.
AB395-ASA1,7,1513 3. If the motor vehicle is in possession of the shared vehicle driver at the time
14of receipt of the notice of recall, notify the peer-to-peer motor vehicle sharing
15program of the recall as soon as practicable after receipt of the notice.
AB395-ASA1,7,20 16(5) Record retention. For each individual who will operate a shared motor
17vehicle under a motor vehicle sharing agreement, a peer-to-peer motor vehicle
18sharing program shall keep a record of the individual's name and address, the
19individual's operator's license number, and the state or foreign country that issued
20the individual's operator's license.
AB395-ASA1,8 21Section 8 . 632.362 of the statutes is created to read:
AB395-ASA1,7,23 22632.362 Peer-to-peer motor vehicle sharing. (1) Definitions. In this
23section:
AB395-ASA1,7,2424 (a) “Motor vehicle” has the meaning given in s. 344.01 (2) (b).
AB395-ASA1,8,4
1(b) “Motor vehicle sharing agreement” means an agreement providing the
2terms and conditions, applicable to a shared vehicle driver and shared vehicle owner,
3that govern the use of a shared motor vehicle through a peer-to-peer motor vehicle
4sharing program.
AB395-ASA1,8,85 (c) “Motor vehicle sharing delivery period” means the period during which a
6shared motor vehicle is being delivered to the location of the motor vehicle sharing
7initiation time, if applicable, as documented by the governing motor vehicle sharing
8agreement.
AB395-ASA1,8,129 (d) “Motor vehicle sharing duration” means the period that commences with
10the motor vehicle sharing delivery period or, if there is no motor vehicle sharing
11delivery period, that commences with the motor vehicle sharing initiation time and,
12in either case, ends at the motor vehicle sharing termination time.
AB395-ASA1,8,1613 (e) “Motor vehicle sharing initiation time” means the time when the motor
14vehicle to be shared becomes subject to the control of the shared vehicle driver at or
15after the time the reservation of a shared motor vehicle is scheduled to begin as
16documented in the records of a peer-to-peer motor vehicle sharing program.
AB395-ASA1,8,1717 (f) “Motor vehicle sharing termination time” means the earliest of the following:
AB395-ASA1,8,2118 1. The expiration of the time agreed upon for the use of the shared motor vehicle
19according to the terms of the motor vehicle sharing agreement, if the shared motor
20vehicle is delivered to the location that is specified in the motor vehicle sharing
21agreement.
AB395-ASA1,9,222 2. The time the shared motor vehicle is returned by the shared vehicle driver
23to a location as alternatively agreed upon by the shared vehicle owner and shared
24vehicle driver, as communicated through a peer-to-peer motor vehicle sharing

1program, which alternatively agreed upon location shall be incorporated into the
2motor vehicle sharing agreement.
AB395-ASA1,9,43 3. The time the shared vehicle owner regains possession and control of the
4shared motor vehicle.
AB395-ASA1,9,75 (g) “Peer-to-peer motor vehicle sharing program” means a business platform
6that connects motor vehicle owners with individuals to enable the authorized use of
7a motor vehicle by an individual other than the owner for financial consideration.
AB395-ASA1,9,118 (h) “Shared vehicle driver” means an individual who is authorized to drive a
9shared motor vehicle under a motor vehicle sharing agreement through a
10peer-to-peer motor vehicle sharing program and who is not the shared vehicle
11owner.
AB395-ASA1,9,1412 (i) “Shared vehicle owner” means the registered owner, or a person or entity
13designated by the registered owner, of a motor vehicle that is available for sharing
14through a peer-to-peer motor vehicle sharing program.
AB395-ASA1,9,20 15(2) Insurance coverage during sharing. (a) A peer-to-peer motor vehicle
16sharing program shall, except as provided in par. (b), assume liability of a shared
17vehicle owner for bodily injury and property damage to 3rd parties and for uninsured
18motorist and personal injury protection losses during the motor vehicle sharing
19duration in amounts stated in the motor vehicle sharing agreement that are no less
20than the following amounts:
AB395-ASA1,9,2221 1. Fifty thousand dollars because of bodily injury to or death of one person in
22any one accident.
AB395-ASA1,9,2423 2. Subject to the limit under subd. 1. for one person, $100,000 because of bodily
24injury to or death of 2 or more persons in any one accident.
AB395-ASA1,10,2
13. If the accident results in injury to or destruction of property, $20,000 because
2of injury to or destruction of property of others in any one accident.
AB395-ASA1,10,43 4. Uninsured motorist coverage under s. 632.32 (4) (a) of $50,000 per person
4and $100,000 per accident.
AB395-ASA1,10,65 (am) An insurer writing a policy with respect to a peer-to-peer motor vehicle
6sharing program shall comply with s. 632.32 (4m).
AB395-ASA1,10,97 (b) Notwithstanding the definition of motor vehicle sharing termination time,
8the assumption of liability under par. (a) does not apply to a shared vehicle owner
9when any of the following occurs:
AB395-ASA1,10,1210 1. The shared vehicle owner makes an intentional or fraudulent material
11misrepresentation or omission to the peer-to-peer motor vehicle sharing program
12before the motor vehicle sharing duration in which the loss occurred.
AB395-ASA1,10,1513 2. The shared vehicle owner acts in concert with a shared vehicle driver who
14fails to return the shared motor vehicle pursuant to the terms of a motor vehicle
15sharing agreement.
AB395-ASA1,10,1916 (c) Notwithstanding the definition of motor vehicle sharing termination time,
17the assumption of liability under par. (a) applies to bodily injury, property damage,
18and uninsured motorist and personal injury protection losses by damaged 3rd
19parties in amounts no less than the minimum amounts set forth in par. (a) 1. to 4.
AB395-ASA1,10,2520 (d) A peer-to-peer motor vehicle sharing program shall ensure that, during
21each motor vehicle sharing duration, the shared vehicle owner and the shared
22vehicle driver are aware of the availability of underinsured motorist coverage and
23are insured under a motor vehicle liability insurance policy that provides insurance
24coverage in amounts no less than the minimum amounts set forth in par. (a) 1. to 4.
25and that satisfies any of the following:

11. The policy recognizes that the shared motor vehicle insured under the policy
2is made available and used through a peer-to-peer motor vehicle sharing program.
AB395-ASA1,11,43 2. The policy does not exclude use of a shared motor vehicle by a shared vehicle
4driver.
AB395-ASA1,11,65 (e) The insurance requirement described under par. (d) may be satisfied by
6motor vehicle liability insurance maintained by any of the following:
AB395-ASA1,11,77 1. A shared vehicle owner.
AB395-ASA1,11,88 2. A shared vehicle driver.
AB395-ASA1,11,99 3. A peer-to-peer motor vehicle sharing program.
AB395-ASA1,11,1010 4. Any combination of the persons described in subds. 1. to 3.
AB395-ASA1,11,1711 (f) The coverage maintained under par. (e) that is satisfying the insurance
12requirement under par. (d) shall be primary during each motor vehicle sharing
13duration and, in the event that a claim occurs in another state with minimum
14financial responsibility limits higher than the amounts specified in par. (a) 1. to 4.
15during the motor vehicle sharing duration, the coverage maintained under par. (e)
16shall satisfy the difference in minimum coverage amounts, up to the applicable policy
17limits.
AB395-ASA1,11,2018 (g) The insurer, insurers, or peer-to-peer motor vehicle sharing program
19providing coverage under pars. (d) and (e) shall assume primary coverage if any of
20the following applies:
AB395-ASA1,11,2321 1. A dispute exists as to who was in control of the shared motor vehicle at the
22time of the loss, and the peer-to-peer motor vehicle sharing program does not have
23available, does not retain, or fails to provide the information specified under sub. (9).
AB395-ASA1,11,2524 2. A dispute exists as to whether the shared motor vehicle was returned to an
25alternatively agreed upon location specified in the motor vehicle sharing agreement.
AB395-ASA1,12,6
1(h) If insurance maintained by a shared vehicle owner or shared vehicle driver
2in accordance with par. (e) has lapsed or does not provide the coverage required, then
3insurance maintained by the peer-to-peer motor vehicle sharing program shall
4provide the coverage required under par. (d) beginning with the first dollar of the
5claim and shall have the duty to defend the claim except under circumstances
6described in par. (b).
AB395-ASA1,12,107 (i) Coverage under a motor vehicle insurance policy maintained by the
8peer-to-peer motor vehicle sharing program may not be dependent on another motor
9vehicle insurer first denying a claim nor shall another motor vehicle insurance policy
10be required to first deny a claim.
AB395-ASA1,12,1111 (j) Nothing in this section does any of the following:
AB395-ASA1,12,1512 1. Limits the liability of a peer-to-peer motor vehicle sharing program for any
13act or omission of the peer-to-peer motor vehicle sharing program itself that results
14in injury to any person as a result of the use of a shared motor vehicle through the
15peer-to-peer motor vehicle sharing program.
AB395-ASA1,12,2016 2. Limits the ability of a peer-to-peer motor vehicle sharing program to seek
17indemnification, under the terms of a motor vehicle sharing agreement, from the
18shared vehicle owner or shared vehicle driver for economic loss sustained by the
19peer-to-peer motor vehicle sharing program resulting from a breach of the terms of
20the motor vehicle sharing agreement.
AB395-ASA1,13,2 21(3) Insurable interest. A peer-to-peer motor vehicle sharing program shall
22have an insurable interest in a shared motor vehicle during the motor vehicle
23sharing duration. Nothing in this subsection creates liability on the peer-to-peer
24motor vehicle sharing program to maintain the coverage required under sub. (2) (d).
25The peer-to-peer motor vehicle sharing program may own and maintain as the

1named insured one or more policies of motor vehicle liability insurance that provides
2coverage for any of the following:
AB395-ASA1,13,43 (a) Liabilities to be assumed by the peer-to-peer motor vehicle sharing
4program under a motor vehicle sharing agreement.
AB395-ASA1,13,55 (b) Any liability of the shared vehicle owner.
AB395-ASA1,13,66 (c) Damage or loss to the shared motor vehicle.
AB395-ASA1,13,77 (d) Any liability of the shared vehicle driver.
AB395-ASA1,13,11 8(4) Exclusions in motor vehicle liability policies. (a) An insurer that writes
9motor vehicle liability insurance in this state may exclude any coverage and may
10refuse to defend or indemnify any claim under a shared vehicle owner's liability
11policy, including any of the following coverages:
AB395-ASA1,13,1212 1. Liability coverage for bodily injury and property damage.
AB395-ASA1,13,1313 2. Personal injury protection.
AB395-ASA1,13,1414 3. Uninsured and underinsured motorists coverage.
AB395-ASA1,13,1515 4. Medical payments.
AB395-ASA1,13,1616 5. Comprehensive physical damage.
AB395-ASA1,13,1717 6. Collision physical damage.
AB395-ASA1,13,2118 (b) Nothing in this section invalidates or limits any exclusion contained in a
19motor vehicle liability insurance policy, including any policy in use or approved for
20use that excludes coverage for motor vehicles that are made available for rent,
21sharing, or hire or for any business use.
AB395-ASA1,13,2422 (c) Nothing in this section invalidates, limits, or restricts an insurer's ability,
23as otherwise allowed under law, to underwrite an insurance policy or to cancel or not
24renew an insurance policy.
AB395-ASA1,14,3
1(5) Required disclosures. Each peer-to-peer motor vehicle sharing program
2shall include in any agreement made in this state with a shared vehicle owner or
3shared vehicle driver all of the following disclosures:
AB395-ASA1,14,74 (a) Any right of the peer-to-peer motor vehicle sharing program to seek
5indemnification from the shared vehicle owner or shared vehicle driver for economic
6loss sustained by the peer-to-peer motor vehicle sharing program resulting from a
7breach of the terms and conditions of the motor vehicle sharing agreement.
AB395-ASA1,14,118 (b) That a motor vehicle liability insurance policy issued to a shared vehicle
9owner for the shared motor vehicle or to the shared vehicle driver does not provide
10a defense or indemnification for any claim asserted against him or her by the
11peer-to-peer motor vehicle sharing program.
AB395-ASA1,14,1712 (c) That the peer-to-peer motor vehicle sharing program's insurance coverage
13on the shared vehicle owner and the shared vehicle driver is in effect only during the
14motor vehicle sharing duration and that, for any use of the shared motor vehicle by
15the shared vehicle driver other than during the motor vehicle sharing duration, the
16shared vehicle driver and the shared vehicle owner might not have insurance
17coverage.
AB395-ASA1,14,1918 (d) The daily rate, fees, and, if applicable, any insurance or protection package
19costs that are charged to the shared vehicle owner or the shared vehicle driver.
AB395-ASA1,14,2120 (e) That the motor vehicle liability insurance policy of the shared vehicle owner
21might not provide coverage for a shared motor vehicle.
AB395-ASA1,14,2322 (f) An emergency telephone number of personnel who are capable of fielding
23roadside assistance and other customer service inquiries.
AB395-ASA1,15,3
1(g) Any conditions under which a shared vehicle driver, in order to make a
2reservation for a shared motor vehicle, must maintain a personal motor vehicle
3insurance policy that is primary coverage with certain applicable coverage limits.
AB395-ASA1,15,11 4(6) Notification of implications of lien. At the time a motor vehicle owner
5registers as a shared vehicle owner through a peer-to-peer motor vehicle sharing
6program and before the shared vehicle owner makes a motor vehicle available for
7sharing, the peer-to-peer motor vehicle sharing program shall notify the shared
8vehicle owner that, if the shared motor vehicle has a lien against it, the use of the
9shared motor vehicle through the peer-to-peer motor vehicle sharing program,
10including any use without coverage for physical damage, may violate the terms of
11any agreement with the lienholder.
AB395-ASA1,15,15 12(7) Liability exemption. Any peer-to-peer motor vehicle sharing program and
13any shared vehicle owner are exempt from liability consistent with 49 USC 30106
14and under any state or local law that imposes liability solely based on vehicle
15ownership.
AB395-ASA1,15,22 16(8) Contribution against indemnification. A motor vehicle insurer that
17defends or indemnifies a claim against a shared motor vehicle that is excluded under
18the terms of the policy shall have the right to seek recovery against the motor vehicle
19insurer of the peer-to-peer motor vehicle sharing program if the claim is made
20against the shared vehicle owner or the shared vehicle driver for loss or injury that
21occurs during the motor vehicle sharing duration and is excluded under the terms
22of the policy.
AB395-ASA1,16,7 23(9) Record retention. A peer-to-peer motor vehicle sharing program shall
24collect and verify records pertaining to the use of a shared motor vehicle, including
25times used, motor vehicle pick up and drop off locations, fees paid by a shared vehicle

1driver, and revenues received by the shared vehicle owner. To facilitate a claims
2coverage investigation, settlement, negotiation, or litigation, the peer-to-peer motor
3vehicle sharing program shall provide, upon request, the records collected under this
4subsection to the shared vehicle owner, the insurer of the shared vehicle owner, or
5the insurer of the shared vehicle driver. The peer-to-peer motor vehicle sharing
6program shall retain the records collected under this subsection for a period not less
7than the applicable time limit for bringing an action specified under ch. 893.
AB395-ASA1,9 8Section 9 . Effective date.
AB395-ASA1,16,109 (1) This act takes effect on the first day of the 10th month beginning after
10publication.
