Relating to Amending Executive Order No. 329
I, Tommy G. Thompson, Governor of the State of Wisconsin, pursuant to Article IV, Section 11 and Article V, Section 4 of the Wisconsin Constitution, do hereby amend Executive Order No. 329 and require the Legislature to consider and act upon the following legislation in addition to the legislation listed in Executive Order No. 329:
4. Legislation relating to excluding agricultural transactions from provisions of the Wisconsin consumer act.
5. Legislation relating to the permit guarantee program of the department of natural resources and requiring the exercise of rule-making authority.
6. Legislation relating to income tax and franchise tax credits for sales taxes paid on fuel and electricity used in manufacturing, the apportionment of income for the corporate income tax and franchise tax and requiring and permitting the promulgation of rules.
7. Legislation relating to food stamps for qualified aliens and making an appropriation.
8. Legislation relating to changing requirements for hospitals, organ procurement organizations, coroners and medical examiners with respect to the potential donation of anatomical gifts and procurement and use of body parts by an organ procurement organization.

April 1998 Special Session Senate Bill 5 provides for the Department of Revenue to exclude one or more of the factors in determining the apportionment factor in computing the income tax or franchise tax liability of corporations that operate in this state and in other states. It is unclear whether the subject of this bill is to be defined as a tax exemption under section 13.52(6) of the statutes.
Therefore, pursuant to Senate Rule 36(2)(c) and section 13.52 (6), Wisconsin Statutes, I am directing the Co-Chairs of the Joint Survey committee on Tax Exemptions to prepare and submit a report in writing setting forth an opinion on the desirability of April 1998 Special Session Senate Bill 5, as a matter of public policy and I have referred the bill to the Joint Committee on Finance.
