The Honorable, The Legislature:
In accordance with s. 227.485(9), Wis. Stats., each agency is required to submit to the chief clerk of each house of the legislature, annually after June 30, a report detailing the number, nature and amounts of claims involved and claims paid, including attorney's fees and expert witness fees to be paid by the state agency, or to the state agency, depending on who the prevailing party was and whether the losing party's position was substantially justified.
DPI has one such pending case, McMorrow v. DPI, Case No. 98-CV-6697, originally filed in Milwaukee County Circuit Court and currently pending in District I in the Wisconsin Court of Appeals. The plaintiffs prevailed against DPI in circuit Court and DPI has appealed. The plaintiffs have made a claim for $4,346.50 in costs and fees. The validity of this claim has not been adjudicated and is on hold pending the outcome of the appeal. This claim could be dismissed or it could be amended and added to depending on the outcome of the appeal.
