21appointed for 2-year terms.
22 (c) The governor shall appoint the chairperson of the council.
23Section 165. 15.227 (24) (a) 4. of the statutes, as created by 1995 Wisconsin
24Act .... (this act), is repealed and recreated to read:
25 15.227 (24) (a) 4. The secretary of education or the secretary's designee.

1Section 166. 15.34 of the statutes is amended to read:
215.34 Department of natural resources; creation. There is created a
3department of natural resources under the direction and supervision of the secretary
4of
natural resources board. The board shall consist of 7 members appointed for
5staggered 6-year terms. At least 3 members of the board shall be from the territory
6north, and at least 3 members of the board shall be from the territory south, of a line
7running east and west through the south limits of the city of Stevens Point. No
8person may be appointed to the natural resources board, or remain a member
9thereof, who is a permit holder or who receives, or has during the previous 2 years
10received, a significant portion of his income directly or indirectly from permit holders
11or applicants for permits issued by the department. For purposes of this section,
12"permit holders" or "applicants for permits" shall not include agencies, departments
13or subdivisions of this state

14Section 167. 15.347 (3) of the statutes is created to read:
15 15.347 (3) Natural resources council. There is created in the department of
16natural resources a natural resources council consisting of 7 members appointed for
176-year terms. At least 3 members of the council shall be from the territory north,
18and at least 3 members of the council shall be from the territory south, of a line
19running east and west through the south limits of the city of Stevens Point. No

14who are knowledgeable in off-the-road sporting and recreational needs of the
15drivers of Type 1 motorcycles and all-terrain vehicles.
16Section 172. 15.347 (13) (b) 2. of the statutes is amended to read:

18development.
19Section 173. 15.347 (15) (a) 2. of the statutes is amended to read:
20 15.347 (15) (a) 2. The secretary of development tourism and parks or his or her

22Section 174. 15.347 (16) of the statutes is renumbered 15.447 (2) and amended
23to read:

115.447 (2) State trails council. There is created in the department of natural
2resources
tourism and parks a state trails council consisting of 9 members, appointed
3for 4-year terms, who are knowledgeable in the various recreational uses of trails.
4Section 175. 15.347 (17) of the statutes is repealed.
5Section 176. 15.348 of the statutes is amended to read:
615.348 Conservation congress. The conservation congress shall be an
7independent organization of citizens of the state and shall serve in an advisory
8capacity to the secretary of natural resources board on all matters under the
9jurisdiction of the board secretary. Its records, budgets, studies and surveys shall be
10kept and established in conjunction with the department of natural resources. Its
11reports shall be an independent advisory opinion of such the congress.
12Section 177. 15.37 of the statutes is amended to read:
1315.37 (title) Department of public instruction education ; creation.
14There is created a department of public instruction education under the direction
15and supervision of the state superintendent secretary of education.
16Section 178. 15.374 (1) of the statutes is amended to read:
17 15.374 (1) Office of educational accountability. There is created an office of
18educational accountability in the department of public instruction education. The
19director of the office shall be appointed by the state superintendent secretary of
20public instruction education.
21Section 179. 15.375 (1) of the statutes is amended to read:
22 15.375 (1) American Indian language and culture education board. There is
23created an American Indian language and culture education board which is attached
24to the department of public instruction education under s. 15.03. The board shall
25consist of 13 members appointed by the governor for staggered 4-year terms from

1recommendations made by the various Indian tribes, bands and organizations in this
2state. The members shall include parents or guardians of American Indian children,
3American Indian teachers, school administrators, a school board member, persons
4involved in programs for American Indian children and persons experienced in the
5training of teachers for American Indian language and culture education programs.
6Members shall be appointed so as to be representative of all the American Indian
7tribes, bands and organizations in this state. In addition to its duties under subch.
8IV of ch. 115, the board shall advise the state superintendent secretary of public
9instruction
education, the board of regents of the university of Wisconsin system, the
10higher educational aids board and the technical college system board on all matters
11relating to the education of American Indians. The board does not have rule-making
12authority.
13Section 180. 15.375 (2) of the statutes is amended to read:
14 15.375 (2) School district boundary appeal board. There is created a school
15district boundary appeal board in the department of public instruction education.
16The board shall consist of 12 school board members appointed by the state
17superintendent
secretary of public instruction education for staggered 2-year terms
18and the state superintendent secretary of public instruction education or his or her
19designee. Four board members shall be school board members of school districts with
20small enrollments, 4 board members shall be school board members of school
21districts with medium enrollments and 4 board members shall be school board
22members of school districts with large enrollments. No 2 school board members of
23the board may reside within the boundaries of the same cooperative educational
24service agency.
25Section 181. 15.375 (3) (b) 1. of the statutes is amended to read:

8 15.377 (1) Council on the education of the blind. There is created in the
9department of public instruction education a council on the education of the blind
10consisting of 3 members, who shall be visually handicapped and shall have a
11recognized interest in and a demonstrated knowledge of the problems of the visually
12handicapped, appointed by the state superintendent secretary of public instruction
13education for staggered 6-year terms. "Visually handicapped" means having a) a
14visual acuity equal to or less than 20/70 in the better eye with correcting lenses, or
15b) a visual acuity greater than 20/70 in the better eye with correcting lenses, but
16accompanied by a limitation in the field of vision such that the widest diameter of the
17visual field subtends an angle no greater than 20 degrees.
18Section 184. 15.377 (3) of the statutes is amended to read:
19 15.377 (3) Council on instructional telecommunications. There is created
20in the department of public instruction education a council on instructional
21telecommunications. The state superintendent secretary of public instruction
22education shall appoint one member to represent each of the cooperative educational
23service agencies, from nominations made by the boards of control of the cooperative
24educational service agencies, and 2 members to represent private primary and

1secondary educational institutions. Council members shall be appointed for 4-year
2terms.
3Section 185. 15.377 (4) of the statutes is amended to read:
4 15.377 (4) Council on exceptional education. There is created in the
5department of public instruction education a council on exceptional education
6consisting of 15 members appointed by the state superintendent secretary of
7education
for 3-year terms. No more than 7 members of the council may be persons
8who do not have children with exceptional educational needs and who are
9representatives of the state, school districts, county handicapped children's
10education boards or cooperative educational service agencies. At least 5 members
11of the council shall be parents or guardians of a child with exceptional educational
12needs, at least one member of the council shall be a school board member, at least
13one member shall be a certified teacher of regular education as defined in s. 115.76
14(9) and at least one member shall be a certified teacher of special education.
15Section 186. 15.377 (6) of the statutes is amended to read:
16 15.377 (6) Council on library and network development. There is created in
17the department of public instruction education a council on library and network
18development composed of 15 members. Seven of the members shall be library
19science, audiovisual and informational science professionals representative of
20various types of libraries and information services, including public libraries, public
21library systems, school libraries, public and private academic libraries, special
22libraries and library educators. Eight of the members shall be public members who
23have demonstrated an interest in libraries or other types of information services.
24The members of the council shall be appointed for 3-year terms. The council shall
25meet 6 times annually and shall also meet on the call of the state superintendent

1secretary of education, and may meet at other times on the call of the chairperson
2or a majority of its members.
3Section 187. 15.377 (7m) of the statutes is amended to read:
4 15.377 (7m) Council on suicide prevention. There is created a council on
5suicide prevention in the department of public instruction education. The council
6shall consist of 2 persons appointed by the state superintendent secretary of public
7instruction
education, at least one of whom is not an employe of the department of
8public instruction education, 2 persons appointed by the secretary of health and
9social services, at least one of whom is not an employe of the department of health
10and social services, one person and one physician appointed jointly by the state
11superintendent
secretary of public instruction education and the secretary of health
12and social services and one person appointed by the executive staff director of the
13office of justice assistance in the department of administration. Members shall be
14appointed for 3-year terms.
15Section 188. 15.435 (1) (a) 1. of the statutes is amended to read:
16 15.435 (1) (a) 1. The secretaries secretary of development and the secretary of
17revenue or their designees;
18Section 189. 15.435 (2) of the statutes is amended to read:
19 15.435 (2) Badger board. There is created a badger board, attached to the
20department of revenue under s. 15.03, consisting of the secretaries of development,
21secretary of tourism and parks, the secretary of revenue and the secretary of natural
22resources, or their designees, the governor in his or her capacity as chairperson of the
23building commission, or his or her designee, and the board of commissioners of public
24lands under article X, section 7, of the constitution.
