9development.

11including records, of the board of regents of the University of Wisconsin System
12primarily used by the recycling market development board, as determined by the
13secretary of administration, are transferred to the department of development.

15Wisconsin System in effect on the effective date of this paragraph that are related
16primarily to the functions of the recycling market development board, as determined
17by the secretary of administration, remain in effect and are transferred to the
18department of development. The department of development shall carry out any
19obligations under those contracts unless modified or rescinded by the department of
20development to the extent allowed under the contract.

9University of Wisconsin System in effect on the effective date of this paragraph that
10are primarily related to the functions of the radioactive waste review board, as

12radioactive waste review board in effect on the effective date of this paragraph
13remain in effect and are transferred to the public service commission. The public
14service commission shall carry out any obligations under those contracts unless
15modified or rescinded by the public service commission to the extent allowed under
16the contract.
AB150-engrossed,2666,22 17(d)  Rules and orders. All rules promulgated by the radioactive waste review
18board that are in effect on the effective date of this paragraph remain in effect until
19their specified expiration dates or until amended or repealed by the public service
20commission. All orders issued by the radioactive waste review board that are in
21effect on the effective date of this paragraph remain in effect until their specified
22expiration date or until rescinded or modified by the public service commission.

24board on the effective date of this paragraph is transferred to the public service
25commission and all materials submitted to or actions taken by the radioactive waste

1review board with respect to the pending matter are considered to have been

AB150-engrossed,2667,3 3(4)  Temporary salary limitation for administrative positions.
AB150-engrossed,2667,12 4(a)  Notwithstanding section 20.923 of the statutes, as affected by this act, and
5sections 36.09 (1) (e) and (j) and 230.12 of the statutes or any action of the board of
6regents of the University of Wisconsin System or the joint committee on employment
7relations, no employe of the University of Wisconsin System whose position is
8identified in section 20.923 (4) (j), (4m) or (5) of the statutes may be paid a salary
9during the period beginning on the effective date of this paragraph and ending on
10June 30, 1997, at an annualized rate which equals or exceeds $100,000 per year or
11the annualized salary paid to the incumbent in the position occupied by the employe
12on January 1, 1995, whichever is greater.
AB150-engrossed,2667,19 13(b)  Paragraph (a) does not apply to that portion of the annualized salary of an
14employe equivalent to any salary increase that was granted to the incumbent in the
15position occupied by the employe pursuant to the compensation plan for executive
16salary group positions under section 230.12 of the statutes prior to July 1, 1995, or
17pursuant to any documented action of the board of regents of the University of
18Wisconsin System under section 20.923 (1), (4m) or (5) or 36.09 (1) (e) or (j) of the
19statutes prior to February 1, 1995.
AB150-engrossed,2667,24 20(c)  Notwithstanding section 16.50 (1) (a) of the statutes, the secretary of
21administration shall not waive submission of expenditure estimates under that
22paragraph for any salary expenditures to which this subsection applies and shall not
23approve any estimate for a proposed expenditure to be made contrary to this
24subsection.

1(5)  Efficiency measures. By September 1, 1995, the University of Wisconsin
2System shall submit a report to the joint committee on finance recommending how
3savings in fiscal year 1995-96 of $8,049,000 and in fiscal year 1996-97 of
4$15,700,900 resulting from budgetary efficiency measures should be allocated
5among the system's general purpose revenue appropriations. The recommendation
6shall include a specific plan that identifies the programs, positions and expenditure
7categories to be eliminated or reduced; and does not include reductions in financial
8aid programs or energy costs or reestimates of debt service payments. If the
9cochairpersons of the committee do not notify the University of Wisconsin System
10that the committee has scheduled a meeting for the purpose of reviewing the report
11within 14 working days after the date of the submittal, the recommendation may be
12implemented as proposed by the system. If, within 14 working days after the date
13of the submittal, the cochairpersons of the committee notify the system that the
14committee has scheduled a meeting for the purpose of reviewing the report, the
15recommendation may be implemented only upon approval of the committee.
AB150-engrossed,2668,18 16(6)  Report on staff reductions. By October 1, 1995, the president of the
17University of Wisconsin System shall submit to the secretary of administration a
18plan identifying his or her intended reductions to system capital budget staff.
AB150-engrossed,2668,23 19(8g)Administrative reductions. During the 1995-97 fiscal biennium, the
20board of regents of the University of Wisconsin System shall allocate its
21administrative reductions to all activities except instruction. By September 1, 1995,
22the board shall submit a report on such reductions to the joint committee on finance
23for the committee's approval.
AB150-engrossed,2669,5 24(9h)Capital planning. During the 1995-97 fiscal biennium, the board of
25regents of the University of Wisconsin System shall submit a report to the

1department of administration and the joint committee on finance on the source of any
2funds that the board plans to reallocate to capital planning. The board may
3implement its reallocation if the committee approves the report, or does not schedule
4a meeting for the purpose of reviewing the report within 14 working days after
5receipt of the report.
AB150-engrossed,2669,9 6(11t)Tuition increases. In the 1995-96 and 1996-97 academic years, the
7board of regents of the University of Wisconsin System shall allocate tuition
8increases to offset base funding reductions as an across-the-board percentage
9increase.

AB150-engrossed,2669,16 11(1g)Tuition and fee reimbursement. Notwithstanding section 45.25 (4) (d) of
12the statutes, as created by this act, the department of veterans affairs may provide
13tuition and fee reimbursement under section 45.25 (2) of the statutes from the
14appropriation under section 20.485 (2) (tf) of the statutes, as affected by this act,
15during the 1995-96 fiscal year for a course that was completed in the spring semester
16of the 1994-95 school year.

AB150-engrossed,2669,20 20(a)  Definitions. In this subsection:
AB150-engrossed,2669,22 211.  "Authority" means the University of Wisconsin Hospitals and Clinics
22Authority.
AB150-engrossed,2669,24 232.  "Board of regents" means the board of regents of the University of Wisconsin
24System.
AB150-engrossed,2670,8
1(b)  Assets and liabilities. The chancellor of the University of
2Wisconsin-Madison and the chairperson of the authority, acting jointly, shall
3identify from the assets and liabilities of the board of regents those assets and
4liabilities that primarily relate to the University of Wisconsin Hospitals and Clinics
5and related services. On June 29, 1996, the assets and liabilities so identified shall
6become the assets and liabilities of the authority, except that assets and liabilities
7that primarily relate to employes identified under subsection (4) (c) shall become the
8assets and liabilities of the University of Wisconsin Hospitals and Clinics Board.
AB150-engrossed,2670,17 9(c)  Tangible personal property. The chancellor of the University of
10Wisconsin-Madison and the chairperson of the authority, acting jointly, shall
11identify the tangible personal property, including records, of the board of regents that
12primarily relates to the University of Wisconsin Hospitals and Clinics and related
13services. On June 29, 1996, the tangible personal property so identified shall become
14the tangible personal property of the authority, except that the tangible personal
15property that primarily relates to employes identified under subsection (4) (c) shall
16become the tangible personal property of the University of Wisconsin Hospitals and
17Clinics Board.

AB150-engrossed,2670,25 191. The chancellor of the University of Wisconsin-Madison and the chairperson
20of the authority, acting jointly, shall determine which contracts entered into by the
21board of regents in effect on June 29, 1996, primarily relate to the University of
22Wisconsin Hospitals and Clinics and related services. Except as provided in
23subdivision 2., all such contracts remain in effect and the authority shall, beginning
24on June 29, 1996, carry out any such contractual obligations until modified or
25rescinded to the extent allowed under the contract.

11subdivision 2., all such rules shall become bylaws or policies and procedures of the
12authority on June 29, 1996, and shall remain in effect until their specified expiration
13date or until amended or repealed by the authority.

15identified under subsection (4) (c) shall become rules of the University of Wisconsin
16Hospitals and Clinics Board on June 29, 1996, and shall remain in effect until their
17specified expiration dates or until amended or repealed by the University of
18Wisconsin Hospitals and Clinics Board.

AB150-engrossed,2672,2 201. The chancellor of the University of Wisconsin-Madison and the chairperson
21of the authority, acting jointly, shall identify all policies and procedures of the
22University of Wisconsin-Madison that are in effect on June 29, 1996, and which
23relate to the University of Wisconsin Hospitals and Clinics and related services.
24Except as provided in subdivision 2., all such policies and procedures shall become

1policies and procedures of the authority on June 29, 1996, and shall remain in effect
2until their specified expiration date or until modified or rescinded by the authority.
AB150-engrossed,2672,7 32. All policies and procedures under subdivision 1. that primarily relate to
4employes identified under subsection (4) (c) shall become policies and procedures of
5the University of Wisconsin Hospitals and Clinics Board on June 29, 1996, and shall
6remain in effect until their specified expiration date or until modified or rescinded
7by the University of Wisconsin Hospitals and Clinics Board.

AB150-engrossed,2672,16 91. The chancellor of the University of Wisconsin-Madison and the chairperson
10of the authority, acting jointly, shall identify those matters pending with the board
11of regents on June 29, 1996, that primarily relate to the University of Wisconsin
12Hospitals and Clinics and related services. Except as provided in subdivision 2., on
13June 29, 1996, any matter so identified shall become a pending matter of the
14authority and all materials submitted to or actions taken by the board of regents with
15respect to the pending matter are considered as having been submitted to or taken
16by the authority.
AB150-engrossed,2672,22 172. On June 29, 1996, any matter identified under subdivision 1. that primarily
18relates to employes identified under subsection (4) (c) shall become a pending matter
19of the University of Wisconsin Hospitals and Clinics Board and all materials
20submitted to or actions taken by the board of regents with respect to the pending
21matter are considered as having been submitted to or taken by the University of
22Wisconsin Hospitals and Clinics Board.
AB150-engrossed,2673,2 23(h)  Secretary of administration to arbitrate disputes. In the case of
24disagreement with respect to any matter specified in this subsection, the secretary

1of administration shall determine the matter and shall develop a plan for an orderly
2transfer.
AB150-engrossed,2673,6 3(i)Applicability of lease and affiliation agreements. Paragraphs (b) to (h) do
4not apply to any matter specified in the lease agreement under section 233.04 (7) of
5the statutes, as created by this act, or the affiliation agreement under section 233.04
6(7m) of the statutes, as created by this act.
AB150-engrossed,2673,9 7(j)Applicability of paragraphs (b) to (h). Paragraphs (b) to (h) do not apply
8after June 1, 1996, unless the joint committee on finance approves the proposed
9agreements under paragraph (k) 5.
AB150-engrossed,2673,11 10(k)Lease, affiliation and contractual services agreements; governor and joint
11committee on finance review.
AB150-engrossed,2673,17 121. The authority and the board of regents shall negotiate and enter into the
13lease agreement specified in sections 36.11 (28) and 233.04 (7) of the statutes, as
14created by this act, to lease the on-campus facilities, as defined in section 233.01 (7)
15of the statutes, as created by this act, beginning on June 29, 1996. The authority and
16the board of regents shall submit the proposed lease agreement to the governor and
17to the joint committee on finance by January 15, 1996.
AB150-engrossed,2673,22 182. The authority and the board of regents shall negotiate and enter into the
19affiliation agreement specified in sections 36.11 (28m) and 233.04 (7m) of the
20statutes, as created by this act, to take effect on June 29, 1996. The authority and
21the board of regents shall submit the proposed affiliation agreement to the governor
22and to the joint committee on finance by January 15, 1996.
AB150-engrossed,2674,3 233. The authority and the University of Wisconsin Hospitals and Clinics Board
24shall negotiate and enter into the contractual services agreement specified in
25sections 146.59 and 233.04 (4) of the statutes, as created by this act, to take effect on

1June 29, 1996. The authority and the University of Wisconsin Hospitals and Clinics
2Board shall submit the proposed contractual services agreement to the governor and
3to the joint committee on finance by January 15, 1996.
AB150-engrossed,2674,7 44. No later than March 1, 1996, the governor shall approve or disapprove each
5of the proposed agreements specified under subdivisions 1. to 3. If, by March 1, 1996,
6the governor disapproves any of the proposed agreements, or does not approve or
7disapprove each of the proposed agreements, the agreements shall not take effect.
AB150-engrossed,2674,16 85. If the governor approves all of the proposed agreements under subdivision
94., the joint committee on finance shall, no later than June 1, 1996, approve or
10disapprove each of the proposed agreements. If the committee approves all of the
11proposed agreements, the agreements shall take effect on June 29, 1996. If, by June
121, 1996, the joint committee on finance disapproves any of the proposed agreements,
13or does not approve or disapprove each of the proposed agreements, the agreements
14shall not take effect. Notwithstanding section 13.10 (4) of the statutes, the governor
15does not have the authority to approve or object to any committee action under this
16subdivision.
AB150-engrossed,2674,21 17(L)Report. At the time of submission of the proposed agreement under
18paragraph (k) 1. or 2., whichever is later, the board of regents shall submit to the
19governor and to the joint committee on finance a report on any savings likely to
20accrue to the state as a result of the transfer of the operation of the University of
21Wisconsin Hospitals and Clinics to the authority.

23University of Wisconsin Hospitals and Clinics Authority
. Notwithstanding the
24length of terms of members of the board of directors of the University of Wisconsin
25Hospitals and Clinics Authority specified under section 233.02 (1) (a) of the statutes,

1as created by this act, the members initially appointed under that paragraph shall
2be appointed for the following terms:

. Notwithstanding the length of terms of members of
8the University of Wisconsin Hospitals and Clinics Board specified under section
915.96 (1) of the statutes, as created by this act, the members initially appointed under
10that subsection shall be appointed for the following terms:

AB150-engrossed,2675,14 14(4)  Status of employes at University of Wisconsin Hospitals and Clinics.
AB150-engrossed,2675,19 15(a) No later than June 29, 1996, the University of Wisconsin Hospitals and
16Clinics Authority shall, if the joint committee on finance approves the agreements
17under subsection (2) (k) 5., offer employment to each person who is an employe at the
18University of Wisconsin Hospitals and Clinics on June 28, 1996, and who is any of
19the following, as determined by the employment relations commission:

AB150-engrossed,2675,21 212. A nonprofessional employe who is a supervisor.
AB150-engrossed,2675,22 223. A management employe.
AB150-engrossed,2675,24 234. An employe who is privy to confidential matters affecting the
24employe-employer relationship.

1(b)  A person who is offered employment under paragraph (a) is deemed to have
2accepted such employment, unless he or she refuses the offer of employment within
310 days of such offer.
AB150-engrossed,2676,13 4(c) Subject to joint committee on finance approval of the agreements under
5subsection (2) (k) 5., on June 29, 1996, all positions at the University of Wisconsin
6Hospitals and Clinics, other than positions occupied by employes described under
7paragraph (a), and all incumbent employes in those positions are transferred to the
8University of Wisconsin Hospitals and Clinics Board. Employes transferred under
9this paragraph have all rights and the same status under subchapter V of chapter
10111 and chapter 230 of the statutes that they enjoyed at the University of Wisconsin
11Hospitals and Clinics. Notwithstanding section 230.28 (4) of the statutes, no
12employe so transferred who has attained permanent status in class may be required
13to serve a probationary period.
AB150-engrossed,2676,21 14(5)  Adjudication of claims arising before termination of coverage. Any
15employe of the University of Wisconsin Hospitals and Clinics Authority who held a
16position with the authority during the period beginning on the effective date of this
17subsection and ending on June 30, 1997, may commence or continue to pursue under
18section 233.10 (3r) (b) 1. of the statutes, as created by this act, any procedural
19guarantee arising from a personnel decision made prior to July 1, 1997, until the
20procedural guarantee is appropriately adjudicated and any appropriate relief is
21granted.
