AB164,1,3 1An Act to renumber 441.115; to amend 441.115 (title); and to create 441.115
2(2) of the statutes; relating to: creating an exception to the nursing licensure
3requirements for certain persons.
Analysis by the Legislative Reference Bureau
Under current law, a person who practices nursing as a registered nurse or
licensed practical nurse must be licensed by the board of nursing (board). In order
to be granted a license by the board, a person must satisfy certain education and
examination requirements. This bill provides that a person who is authorized to
practice nursing under a credential granted by another state, territory, country or
province may provide nursing services in this state to certain persons for not more
than 60 days a year if the board determines that the requirements of the state,
territory, country or province that granted the person's credential are substantially
equivalent to the licensure requirements in this state. A person who is permitted to
provide nursing services under the bill may provide nursing services only to the
following: 1) a patient being transported through or into this state for the purpose
of receiving medical care; or 2) a person who is in this state temporarily, if that person
is a resident of the state, territory, country or province that granted the credential
to the person providing nursing services.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 3. 441.115 (2) of the statutes is created to read:
AB164,2,72 441.115 (2) (a) In this subsection, "nursing credential" means a license, permit
3or certificate of registration or certification that is granted to a person by another
4state or territory or by a foreign country or province and that authorizes or qualifies
5the person holding the credential to perform acts that are substantially the same as
6those performed by a person licensed as a registered nurse or licensed practical nurse
7under this chapter.
AB164,2,138 (b) A person who holds a nursing credential may practice professional or
9practical nursing in this state, as provided under par. (c), for not more than 60
10working days each year without holding a license granted by the board under this
11chapter if the board determines that the requirements for the nursing credential that
12the person holds are substantially equivalent to the requirements for licensure
13under this chapter.
AB164,2,1614 (c) A person who is permitted to practice professional or practical nursing
15under par. (b) may practice professional or practical nursing only for the following
16persons:
AB164,2,1817 1. A person who is being transported through or into this state for the purpose

AB164,2,2119 2. A person who is in this state temporarily, if the person is a resident of the
20state, territory, country or province that granted the nursing credential to the person
