SB345,1,2 1An Act to renumber and amend 144.405 (5) (a); and to create 144.405 (5) (a)
22. of the statutes; relating to: eligibility for vapor recovery grants.

Under the gasoline vapor recovery grant program, which ends on December 31,
1995, the department of natural resources (DNR) pays a portion of the costs incurred
after August 15, 1990, for installing equipment to recover vapors released when
gasoline is pumped into a motor vehicle at a gasoline station located in an area of this
state in which federal standards for ozone pollution are exceeded. Under current law,
in order to be eligible for a grant, the vapor recovery equipment must be connected
to a pump that is attached to a gasoline storage tank that was installed on or before
August 15, 1991, or to a pump that is attached to a gasoline storage tank that was
installed after August 15, 1991, but that does not increase the storage tank capacity
of the gasoline station in existence on August 15, 1991.
This bill expands the vapor recovery grant program to include grants for a
portion of the costs, excluding excavation costs, incurred for installing vapor recovery
equipment at retail gasoline stations, located in the ozone nonattainment area, on
which construction began after August 15, 1991, and before May 1, 1993.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1144.405 (5) (a) (intro.) The department shall develop, implement and
2administer a program to provide financial all of the following:

4for costs directly incurred after August 15, 1990, for the design, acquisition and
5installation of a vapor control system necessary for the owner or operator to comply
6with rules requiring the installation of a vapor control system on those portions of
7a gasoline dispensing facility located in an ozone nonattainment area with a
8classification under 42 USC 7511 (a) of moderate or worse that relate to a stationary
9storage tank installed on or before August 15, 1991, or on those portions of a gasoline
10dispensing facility located in an ozone nonattainment area with a classification
11under 42 USC 7511 (a) of moderate or worse that relate to a stationary storage tank
12installed after August 15, 1991, that does not increase the stationary storage tank
13capacity of the gasoline dispensing facility in existence on August 15, 1991.
