SB552,1,2 1An Act to create 84.09 (5r) of the statutes; relating to: authorizing the
2department of transportation to donate property for veterans memorials.

Under current law, the department of transportation (DOT) may, with the
approval of the governor, sell at public or private sale state property that is under its
jurisdiction when DOT determines that the property is not necessary for highway
purposes and, if real property, is not subject to a petition for the transfer of surplus
state real property to the department of administration.
In lieu of selling such property at public or private sale, this bill allows DOT,
with the approval of the governor, to donate the property to the Wisconsin Vietnam
Veterans Memorial Project, Inc., for the veterans memorial site located at The
Highground in Clark County or to any organization of U.S. war veterans for the
erection of a memorial hall.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB552, s. 1 3Section 1. 84.09 (5r) of the statutes is created to read:
SB552,2,164 84.09 (5r) In lieu of the sale or conveyance of property under sub. (5) or (5m),
5the department may, subject to the approval of the governor, donate property of
6whatever nature owned by the state and under the jurisdiction of the department to
7the Wisconsin Vietnam Veterans Memorial Project, Inc., for the purpose of the

1veterans memorial site located at The Highground in Clark County or to any
2organization specified in s. 70.11 (9) for the purpose of a memorial hall specified in
3s. 70.11 (9). The department may only donate real property under this subsection
4when the department determines that the property is no longer necessary for the
5state's use for highway purposes and, if real property, the real property is not the
6subject of a petition under s. 16.375 (2). The department shall present to the
7governor a full and complete report of the property to be donated, the reason for the
8donation, and the minimum price for which the property could likely be sold under
9sub. (5), together with an application for the governor's approval of the donation. The
10governor shall thereupon make such investigation as he or she considers necessary
11and approve or disapprove the application. Upon such approval, the department
12shall by appropriate deed or other instrument transfer the property to the donee.
13The approval of the governor is not required for donation of property having a fair
14market value at the time of donation of not more than $3,000. Any expense incurred
15by the department in connection with the donation shall be paid from the
16transportation fund.
