AB133,1,2 An Act to renumber and amend 174.12 (3); to amend 59.54 (20); and to create 174.14 of the statutes; relating to: local regulation of dogs based on breed.

This bill prohibits a city, village, town or county from enacting or enforcing any provision that is based on breed in an ordinance for the regulation of dogs.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB133, s. 1 Section 1. 59.54 (20) of the statutes is amended to read:

AB133,1,8 59.54 (20) Dogs running at large. The board may enact ordinances regulating the keeping, apprehension, impounding and destruction of dogs outside the corporate limits of any city or village, but such ordinances shall not conflict with ss. 174.01 and, 174.042 and 174.14 (2), and such ordinances may not apply in any town that has enacted an ordinance under s. 60.23 (30).

AB133, s. 2 Section 2. 174.12 (3) of the statutes is renumbered 174.14 (1) and amended to read:

AB133,2,7 174.14 (1) This chapter shall does not in any way limit the existing right or authority of any town, village or city to pass ordinances for the keeping and regulating of dogs, or repeal or annul any existing statute or ordinance or local regulation governing the keeping and regulating of dogs; but on and after July 1, 1920, except as provided in sub. (2) and except that no town, village or city shall may pass any ordinance for the licensing of dogs, and all town, village or city ordinances and local regulations licensing dogs then in force shall be null and are void.

AB133, s. 3 Section 3. 174.14 of the statutes is created to read:

AB133,2,9 174.14 Local regulation.

AB133,2,11 (2) A city, village, town or county may not enact or enforce any provision that is based upon breed in an ordinance for the keeping or regulating of dogs .
