Analysis by the Legislative Reference Bureau
Under current law, with certain exceptions, a person may not practice
psychology unless he or she is granted a license by the psychology examining board
(board) in the department of regulation and licensing (DORL). This prohibition does
not apply to a person who practices music, art or dance therapy if he or she submits
evidence to the board that he or she is certified, registered or accredited as a music,
art or dance therapist by a national organization which is approved by the board.
This exemption from the prohibition does not apply after October 1, 1999.
This bill transfers administration of this licensure exemption from the board
to DORL. In addition, DORL is required to issue a certificate of registration as a
music, art or dance therapist to a person who pays an initial credential fee and
submits evidence that he or she is certified, registered or accredited by a national
organization approved by DORL. Finally, the bill repeals the October 1, 1999, sunset
of the licensure exemption.

enact as follows:

15granted under par. (a) if such an organization revokes such a certification,
16registration or accreditation.

18s. 440.08 (2) (a). Renewal applications shall be submitted to the department on a
19form provided by the department and shall include the renewal fee specified in s.
20440.08 (2) (a) and evidence satisfactory to the department that the person's

1certification, registration or accreditation specified in par. (a) 1. a., 2. a. or 3. a. has
2not been revoked.

SB337,3,14 7440.215 Enforcement regarding music, art and dance therapists. (1)
8A violation of s. 455.02 (1m) by a person specified in s. 455.02 (2m), (mt), (mx) or (mz)
9may be enjoined in an action brought by the attorney general on petition by the
10department. In any such proceeding, it shall not be necessary to show that any
11person is individually injured by the actions complained of. If the respondent is
12found guilty of the violation, the court shall enjoin the respondent from further
13violations thereof until he or she is registered under s. 440.03 (13) (a). The remedy
14given by this subsection is in addition to criminal prosecution under sub. (2).

16(1m) may be fined not more than $200 or imprisoned not more than 6 months or both.

19prosecution under s. 455.11. This section does not apply to a violation of s. 455.02
20(1m) by a person specified in s. 455.02 (2m) (mt), (mx) or (mz).
