to create 125.12 (2) (ag) 8., 125.12 (4) (ag) 9.
2and 134.77 (3m) of the statutes;
relating to: the volume of malt liquor
3containers and providing a penalty.
Analysis by the Legislative Reference Bureau
This bill prohibits the sale and offering for sale in this state of containers of malt
liquor that contain more than a quart of that beverage. A person who violates that
prohibition is liable for a forfeiture of not more than $500 for a first offense, for a
forfeiture of not more than $1,000 for a second offense and may have his or her license
to sell alcohol beverages revoked or suspended for a third offense.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

(3m) Malt liquor containers. No person may sell or offer to sell at
5retail in this state any single container of malt liquor that contains more than a quart
6of that beverage, if the city, village or town in which the sale or offer occurs has
7enacted an ordinance that forbids such a sale or offer.

4. 134.77 (4) of the statutes is amended to read:

(4) Penalty. Any person who violates sub. (2) or (3) shall forfeit not more
10than $500 for each violation. Each day of violation constitutes a separate offense.
11Any person who violates sub. (3m) shall forfeit not more than $500 for a first offense,
12not more than $1,000 for a 2nd offense and shall be subject to revocation or
13suspension of that person's license to sell alcohol beverages for a 3rd offense.
