AB242,1,5 1An Act to amend 85.103 (6), 343.07 (1) (intro.), 343.19 (1) and 343.50 (4); and
2to create 343.14 (2) (em) and 343.234 of the statutes; relating to: the
3disclosure of information obtained by the department of transportation from
4applications for drivers' licenses, permits, or identification cards to the selective
5service system for the purposes of registration with the selective service system.
Analysis by the Legislative Reference Bureau
Under federal law, most males who are at least 18 years of age but less than 26
years of age are required to register with the selective service system for possible
conscription into service in the U.S. military. This bill provides that the department
of transportation (DOT) must notify a male who is at least 18 years of age but less
than 26 years of age and who applies for any driver's license, permit, or identification
card that his application will be forwarded to the selective service system for the
purpose of registration with the selective service system. The bill also requires DOT
to forward the application of any male who is at least 18 years of age but less than
26 years of age to the selective service system for the purpose of selective service
registration.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB242, s. 1 1Section 1. 85.103 (6) of the statutes is amended to read:
AB242,2,52 85.103 (6) The department may disclose the personal identifier of any person
3who has made a designation under sub. (2) or (3) if the department discloses the
4personal identifier under s. 341.17 (9), 343.234, 343.235, 343.24 (3) and (4), or
5343.245 (3m).
AB242, s. 2 6Section 2. 343.07 (1) (intro.) of the statutes is amended to read:
AB242,2,167 343.07 (1) Regular permit; issuance, restrictions. (intro.) Upon application
8therefor by a person at least 15 years and 6 months of age who, except for age or lack
9of training in the operation of a motor vehicle, is qualified to obtain an operator's
10license and has passed such knowledge test as the department may require, the
11department may issue a regular instruction permit. If the application is made by a
12male who is at least 18 years of age but less than 26 years of age, the application shall
13include the information required under s. 343.14 (2) (em).
The permit entitles the
14permittee to operate a motor vehicle, except a commercial motor vehicle, school bus,
15or Type 1 motorcycle, a motor bicycle, or a moped, upon the highways, subject to the
16following restrictions:
AB242, s. 3 17Section 3. 343.14 (2) (em) of the statutes is created to read:
AB242,3,218 343.14 (2) (em) If the application is made by a male who is at least 18 years of
19age but less than 26 years of age, the form shall notify the applicant that, by
20submitting the application to the department, the applicant gives his consent to be
21registered, if required by federal law, with the selective service system and that he

1authorizes the department to forward information to the selective service system
2under s. 343.234.
AB242, s. 4 3Section 4. 343.19 (1) of the statutes is amended to read:
AB242,3,174 343.19 (1) If a license issued under this chapter or an identification card issued
5under s. 343.50 is lost or destroyed or the name or address named in the license or
6identification card is changed or the condition specified in s. 343.17 (3) (a) 12. or 13.
7no longer applies, the person to whom the license or identification card was issued
8may obtain a duplicate thereof or substitute therefor upon furnishing proof
9satisfactory to the department of name and date of birth and that the license or
10identification card has been lost or destroyed or that application for a duplicate
11license or identification card is being made for a change of address or name or
12because the condition specified in s. 343.17 (3) (a) 12. or 13. no longer applies. If the
13applicant is a male who is at least 18 years of age but less than 26 years of age, the
14application shall include the information required under s. 343.14 (2) (em).
If the
15original license or identification card is found it shall immediately be transmitted to
16the department. Duplicates of nonphoto licenses shall be issued as nonphoto
17licenses.
AB242, s. 5 18Section 5. 343.234 of the statutes is created to read:
AB242,4,2 19343.234 Department to furnish information to the selective service
20system.
Notwithstanding any other provision in this chapter, the department shall
21forward to the selective service system, in electronic format, any information on an
22application for a driver's license, permit, or identification card submitted under this
23chapter by a male who is at least 18 years of age but less than 26 years of age that
24is requested by the selective service system for the purpose of registering the
25applicant with the selective service system. This section does not apply if the

1selective service system does not register applicants with the selective service
2system on the basis of information forwarded under this section.
AB242, s. 6 3Section 6. 343.50 (4) of the statutes is amended to read:
AB242,4,134 343.50 (4) Application. The application for an identification card shall include
5any information required under ss. 85.103 (2) and 343.14 (2) (a), (b), (bm) and, (br),
6and (em), such further information as the department may reasonably require to
7enable it to determine whether the applicant is entitled by law to an identification
8card, and, for applicants who are aged 65 years or older, material, as provided by the
9department, explaining the voluntary program that is specified in s. 71.55 (10) (b).
10The department shall, as part of the application process, take a photograph of the
11applicant to comply with sub. (3). No application may be processed without the
12photograph being taken. Misrepresentations in violation of s. 343.14 (5) are
13punishable as provided in s. 343.14 (9).
AB242, s. 7 14Section 7. Initial applicability.
AB242,4,1615 (1) This act first applies to applications submitted to the department of
16transportation made on the effective date of this subsection.
AB242, s. 8 17Section 8. Effective date.
AB242,4,1918 (1) This act takes effect on the first day of the 6th month beginning after
19publication.
