AB252,1,3 1An Act to amend 20.395 (2) (eq), 20.395 (2) (ev) and 20.395 (2) (ex); and to create
284.175 of the statutes; relating to: a bicycle and pedestrian inspection and
3inventory program and making appropriations.
Analysis by the Legislative Reference Bureau
Under current law, the department of transportation (DOT) administers a
highway bridge inspection and inventory program under which all highway bridges
are required to be inspected on a continuing basis as determined by DOT. Under the
program, continuing inspections are conducted by DOT with respect to highway
bridges under its jurisdiction and by local authorities with respect to highway
bridges under their jurisdictions.
This bill creates a bicycle and pedestrian bridge inspection and inventory
program under which DOT is directed to complete by January 1, 2003, an inspection
and inventory of all public bridges that are designed to be used primarily for bicycle
or pedestrian travel. The bill also requires that all bicycle and pedestrian bridges
be inspected on a continuing basis as determined by DOT. Continuing inspections
are to be conducted by DOT with respect to bicycle and pedestrian bridges under its
jurisdiction and by local authorities with respect to bicycle and pedestrian bridges
under their jurisdictions.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB252, s. 1 1Section 1. 20.395 (2) (eq) of the statutes is amended to read:
AB252,2,82 20.395 (2) (eq) Highway and local bridge improvement assistance, state funds.
3As a continuing appropriation, the amounts in the schedule for bridge development,
4construction, and rehabilitation under s. 84.18,; for the development and
5construction of bridges under ss. 84.12 and 84.17,, 84.17, and 84.175; for payments
6to local units of government for jurisdictional transfers under s. 84.16; and for the
7improvement of the state trunk highway system under 1985 Wisconsin Act 341,
8section 6 (1).
AB252, s. 2 9Section 2. 20.395 (2) (ev) of the statutes is amended to read:
AB252,2,1210 20.395 (2) (ev) Local bridge improvement assistance, local funds. All moneys
11received from any local unit of government or other source for improving bridges
12under ss. 84.12, 84.17, 84.175, and 84.18, for such purposes.
AB252, s. 3 13Section 3. 20.395 (2) (ex) of the statutes is amended to read:
AB252,2,1614 20.395 (2) (ex) Local bridge improvement assistance, federal funds. All moneys
15received from the federal government for improving bridges under ss. 84.12, 84.17,
1684.175,
and 84.18, for such purposes.
AB252, s. 4 17Section 4. 84.175 of the statutes is created to read:
AB252,2,19 1884.175 Bicycle and pedestrian bridge inspection and inventory. (1) In
19this section:

1(a) "Bicycle bridge" means a public structure in this state that crosses a
2waterway, a topographical barrier, a highway, or a railroad, and which is designed
3to be used primarily for bicycle travel.
AB252,3,64 (b) "Pedestrian bridge" means a public structure in this state that crosses a
5waterway, a topographical barrier, a highway, or a railroad, and which is designed
6to be used primarily for pedestrian travel.
AB252,3,97 (c) "Rehabilitating" means making major repairs necessary to restore the
8structural integrity of a bicycle or pedestrian bridge or making repairs necessary to
9correct a major safety defect.
AB252,3,21 10(2) The department shall conduct an inspection and inventory of all bicycle and
11pedestrian bridges in this state under its jurisdiction. The inspection and inventory
12of local bicycle and pedestrian bridges shall be done in consultation with local
13authorities with respect to bicycle and pedestrian bridges under their jurisdictions.
14The department shall complete the inspection and inventory required under this
15subsection by January 1, 2003. The inspection and inventory shall include all bicycle
16and pedestrian bridges in the state. The department shall classify each bicycle or
17pedestrian bridge according to its safety, serviceability, and necessity for public use
18and shall determine the cost of rehabilitating the bicycle or pedestrian bridge or of
19replacing the bicycle or pedestrian bridge with a comparable facility. The
20department shall adopt standards for the bicycle and pedestrian bridge inspection
21and inventory program under this subsection.
AB252,4,2 22(3) After the initial inspection and inventory under sub. (2) is completed, all
23bicycle and pedestrian bridges in the state shall be inspected on a continuing basis
24as determined by the department. The department shall establish standards for the

1continuing inspection program. The responsibility for the continuing inspection
2program shall be as follows:
AB252,4,43 (a) The department shall be responsible for inspecting the bicycle and
4pedestrian bridges under its jurisdiction.
AB252,4,65 (b) Local authorities shall be responsible for inspecting bicycle and pedestrian
6bridges under their jurisdictions.
