AB582,1,3 1An Act to amend 118.06 (2); and to create 121.006 (3) of the statutes; relating

the requirement to offer the pledge of allegiance or the national anthem in
3school.
Analysis by the Legislative Reference Bureau
Current law requires every public and private school to offer the pledge of
allegiance or the national anthem in grades one to 12 each school day. This bill
provides that, if a school offers the national anthem, it must offer both the music and
the words. The bill also directs the state superintendent of public instruction to
withhold state aid from any school district that violates these requirements.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB582, s. 1 4Section 1. 118.06 (2) of the statutes, as affected by 2001 Wisconsin Act 16, is
5amended to read:
AB582,2,56 118.06 (2) Every public school shall offer the pledge of allegiance or the national
7anthem in grades one to 12 each school day. Every private school shall offer the
8pledge of allegiance or the national anthem in grades one to 12 each school day unless

1the governing body of the private school determines that the requirement conflicts
2with the school's religious doctrines. If a school offers the national anthem, it shall
3offer both the music and the words.
No pupil may be compelled, against the pupil's
4objections or those of the pupil's parents or guardian, to recite the pledge or to sing
5the anthem.
AB582, s. 2 6Section 2. 121.006 (3) of the statutes is created to read:
AB582,2,87 121.006 (3) The state superintendent shall withhold state aid under this
8chapter from any school district that violates the requirement under s. 118.06 (2).
