AB654,1,3 1An Act to amend 20.515 (1) (a); and to create 40.27 (4) of the statutes; relating
2to:
granting military service credit for certain teacher annuitants under the
3Wisconsin retirement system and making an appropriation.
Analysis by the Legislative Reference Bureau
Under current law, participating employees in the Wisconsin retirement
system (WRS) may receive creditable military service, for the purpose of calculating
retirement benefits, for active service in the various branches of the U.S. armed
forces if certain conditions are met. One of the conditions is that the employee must
have terminated WRS covered employment on or after January 1, 1982.
This bill provides that an annuitant who terminated WRS covered employment
during 1981, who at the time of termination was a teacher, and who had at least 30
years of creditable service must be granted creditable military service for active
service in the various branches of the U.S. armed forces. In order to qualify for the
creditable military service, the annuitant, no later than the first day of the fourth
month beginning after the effective date of the bill, must furnish to the department
of employee trust funds evidence that the annuitant's service included active service
in the various branches of the U.S. armed forces and that all applicable conditions
are satisfied other than the employee's termination date. The creditable military
service granted under the bill may only be used for the calculation of a WRS annuity
payment that is paid after the effective date of the bill.
This bill will be referred to the joint survey committee on retirement systems
for a detailed analysis, which will be printed as an appendix to this bill.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB654, s. 1 1Section 1. 20.515 (1) (a) of the statutes is amended to read:
AB654,2,62 20.515 (1) (a) Annuity supplements and payments. A sum sufficient to pay the
3benefits authorized under ss. 40.02 (17) (d) 2. and 40.27 (1), (1m) and, (3), and (4) in
4excess of the amounts payable under other provisions of ch. 40 and to reimburse any
5amounts expended under par. (w) for the costs of administering the benefits provided
6under ss. 40.02 (17) (d) 2. and 40.27 (1), (1m) and, (3), and (4).
AB654, s. 2 7Section 2. 40.27 (4) of the statutes is created to read:
AB654,2,198 40.27 (4) Benefit adjustment for certain teacher annuitants with active
9military service.
(a) Notwithstanding s. 40.02 (15) (c) 5., any annuitant who
10terminated covered employment during 1981, who at the time of termination was a
11teacher, and who had at least 30 years of creditable service shall be granted
12creditable military service under s. 40.02 (15) (c) for any service in the U.S. armed
13forces specified under s. 40.02 (15) (a). In order to qualify for the creditable military
14service, the annuitant, no later than the first day of the 4th month beginning after
15the effective date of this paragraph .... [revisor inserts date], shall furnish to the
16department evidence satisfactory to the department that the annuitant satisfies the
17standards required under s. 40.02 (15) (a). The creditable military service granted
18under this paragraph may only be used for the calculation of an annuity payment
19that is paid after the effective date of this paragraph .... [revisor inserts date].

1(b) Any benefits authorized under par. (a) for any annuitant, which are in
2excess of the amounts otherwise payable to the annuitant under other provisions of
3this chapter, shall be paid from the appropriation under s. 20.515 (1) (a).
