AB757,1,3 1An Act to amend 20.395 (3) (cx) and 20.395 (4) (ax); and to create 85.285 of the
2statutes; relating to: vehicle extrication training grants, granting
3rule-making authority, and making an appropriation.
Analysis by the Legislative Reference Bureau
This bill requires the department of transportation (DOT) to make an annual
grant of $375,000, beginning in fiscal year 2002-03, to an organization to teach
extrication techniques and skills to rescue personnel for various vehicles.
Individuals providing the teaching on behalf of the organization must have
experience in teaching extrication techniques and skills. After awarding a grant,
DOT must enter into a written agreement with the recipient of the grant that
specifies the conditions for use of the grant proceeds and requires the grant recipient
to avoid conflicts of interest in the acquisition or use of vehicle extrication equipment,
as determined by rule by DOT.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB757, s. 1 4Section 1. 20.395 (3) (cx) of the statutes is amended to read:

120.395 (3) (cx) State highway rehabilitation, federal funds. All moneys
2received from the federal government for improvement of existing state trunk and
3connecting highways; for improvement of bridges on state trunk or connecting
4highways and other bridges for which improvement is a state responsibility, for
5necessary approach work for such bridges and for replacement of such bridges with
6at-grade crossing improvements; for the construction and rehabilitation of the
7national system of interstate and defense highways and bridges and related
8appurtenances; for special maintenance activities under s. 84.04 on roadside
9improvements and; for the disadvantaged business demonstration and training
10program under s. 84.076; and for vehicle extrication training grants under s. 85.285,
11for such purposes.
AB757, s. 2 12Section 2. 20.395 (4) (ax) of the statutes, as affected by 2001 Wisconsin Act 16,
13is amended to read:
AB757,2,2414 20.395 (4) (ax) Departmental management and operations, federal funds. All
15moneys received from the federal government for the administration and
16management of departmental programs except those programs under subs. (2) (bx)
17and (dx) and (3) (ix), and; for departmental planning and administrative activities,
18including all moneys received as federal aid as authorized by the governor under s.
1916.54 to promote highway safety and continue the local traffic safety representatives
20program and for purposes of s. 85.07 and; for activities related to the transportation
21employment and mobility program under s. 85.24 that are not funded from the
22appropriation under sub. (1) (bs), (bv), or (bx),; and for vehicle extrication training
23grants under s. 85.285;
and to transfer to the appropriation account under s. 20.505
24(1) (z) the amounts in the schedule under s. 20.505 (1) (z), for such purposes.
AB757, s. 3 25Section 3. 85.285 of the statutes is created to read:

185.285 Vehicle extrication training grants. (1) From the appropriations
2under s. 20.395 (3) (cx) or (4) (ax), the department shall award a grant of $375,000
3from federal funds received under 23 USC 402 in fiscal year 2002-03 and in each
4fiscal year thereafter to an organization that has the knowledge, experience, and
5networking capabilities that are necessary to design and implement vehicle
6extrication certification courses that meet any applicable standards of the National
7Fire Protection Association, and train-the-trainer programs that prepare and train
8instructors to teach extrication skills and techniques to rescue personnel for all types
9of vehicles. A grant may not be awarded under this subsection to a manufacturer or
10seller of vehicle extrication equipment.
AB757,3,21 11(2) Grants awarded under sub. (1) may be used to provide vehicle extrication
12certification courses, learning symposiums, and train-the-trainer programs;
13extrication research and development; design and development of curriculum
14materials; professional services; and acquisition of tools and equipment for the
15implementation of vehicle extrication certification courses and train-the-trainer
16programs. All such programs and courses shall include certification related to
17vehicle extrication knowledge, skills, techniques, and countermeasures necessary
18for rescue personnel to implement solutions that provide a quick and safe extrication
19rescue for automobiles, school buses, motor carriers, taxicabs, commuter car pool or
20van pool vehicles, light trucks, heavy trucks, and vehicles providing specialized
21transportation services to the disabled.
AB757,4,3 22(3) Upon awarding a grant under sub. (1), the department shall enter into a
23written agreement with the recipient of the grant that specifies the conditions for use
24of the grant proceeds, including the use of any training curriculum developed with
25grant proceeds, and which requires the recipient of the grant to avoid any situation

1that would create a conflict of interest, or the appearance of a conflict of interest, with
2respect to the acquisition or use of any vehicle extrication equipment, as determined
3by the department by rule.
AB757, s. 4 4Section 4. Nonstatutory provisions.
AB757,4,85 (1) The department of administration shall submit in proposed form the rule
6required under section 85.285 (3) of the statutes, as created by this act, to the
7legislative council staff under section 227.15 (1) of the statutes no later than the first
8day of the 4th month beginning after the effective date of this subsection.
