AB900,1,2 1An Act relating to: expenditure of $10,842 from the general fund in payment
2of a claim against the state made by Terri Nielson d/b/a Tech Trak Consulting.

This bill directs expenditure of $10,842 from the general fund in payment of a
claim made by Terri Nielson d/b/a Tech Trak Consulting against the department of
administration (DOA). The claimant entered into a contract with DOA to provide
technical writing services at an hourly rate for the period from July 1, 1999 to June
30, 2000, for a total of $78,000. The claimant contends that she did not request to
be relieved of her projects under the contract. Nevertheless, DOA terminated the
contract on May 31, 2000. The claimant claimed $10,842, representing her
estimated income lost as a result of the early termination. DOA contends that the
contract was open-ended and that the total amount was estimated based upon
potential hours worked at the hourly rate provided in the contract. DOA further
alleges that the claimant did not perform the work to which she was assigned. On
December 21, 2001, the claims board recommended denial of this claim (see Senate
Journal
, p. 493).

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. Claim against the state. There is directed to be expended from
2the appropriation under section 20.505 (4) (d) of the statutes, as affected by the acts
3of 2001, $10,842 in payment of a claim against the state made by Terri Nielson d/b/a
4Tech Trak Consulting, Reedsburg, Wisconsin, to compensate the claimant for lost
5income from a contract with the department of administration for the period from
6July 1, 1999, to June 30, 2000, that was terminated by the department prior to its
7expiration date. Acceptance of this payment releases this state and its officers,
8employees, and agents from any further liability resulting from damages incurred
9by the claimant as a result of termination of this contract.
