AB929,1,3 1An Act to create 560.055 of the statutes; relating to: requiring the department
2of commerce to develop a broadband Internet service provider map and
3database and granting rule-making authority.

This bill requires the department of commerce (department) to develop,
maintain, and keep current a database that identifies all the broadband Internet
service providers that are available to a member of the public or consumer in this
state based on the member's or consumer's location and the cost of the different
broadband Internet services that are available to a member of the public or
consumer. "Broadband Internet service provider" is defined as a governmental or
private provider of "broadband Internet service," which is defined as a service that
provides access to the Internet through a technology other than analog technology.
The bill also requires the department to develop, maintain, and keep current
a map that identifies all the broadband Internet service providers that are available
to a member of the public or consumer in this state, but only if the department
determines that it is practicable to develop and maintain such a map and that the
map would provide beneficial information to members of the public or consumer in
this state.
The bill also requires the department to make the map and database available
to the public at no cost, including by making them available over the Internet.
Finally, the bill requires the department to promulgate rules that require broadband
Internet service providers to supply the department with any information necessary
for the department to carry out its duties under the bill.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB929, s. 1 1Section 1. 560.055 of the statutes is created to read:
AB929,2,2 2560.055 Broadband Internet information. (1) In this section:
AB929,2,43 (a) "Broadband Internet service" means a service that provides access to the
4Internet through a technology other than analog technology.
AB929,2,65 (b) "Broadband Internet service provider" means a governmental or private
6provider of broadband Internet service.
AB929,2,7 7(2) The department shall do all of the following:
AB929,2,128 (a) Develop, maintain, and keep current a database that identifies all the
9broadband Internet service providers that are available to a member of the public or
10consumer in this state based on the member's or consumer's location and the cost of
11the different broadband Internet services offered by such broadband Internet service
12providers.
AB929,2,1813 (b) Develop, maintain, and keep current a map that identifies all the broadband
14Internet service providers that are available to a member of the public or consumer
15in this state based on the member's or consumer's location, if the department
16determines that it is practicable to develop, maintain, and keep current such a map
17and if the map would provide beneficial information to members of the public or
18consumers in this state.
AB929,2,2119 (c) Make the database under par. (a) and any map under par. (b) available to
20the public at no cost, including by making the database and map available over the
21Internet.

1(d) Promulgate rules that require broadband Internet service providers to
2supply the department with any information necessary for the department to carry
3out its duties under this section.
AB929, s. 2 4Section 2. Nonstatutory provisions.
AB929,3,95 (1) Rules deadline. The department of commerce shall submit in proposed
6form the rules required under section 560.055 (2) (d) of the statutes, as created by
7this act, to the legislative council staff under section 227.15 (1) of the statutes no later
8than the first day of the 10th month beginning after the effective date of this
9subsection.
