AJR67,1,2 1Relating to: memorializing Congress to pass House Resolution 97, the Notch
2Fairness Act of 2001.
AJR67,1,53 Whereas, the "Notch problem" refers to the disparity in Social Security benefits
4paid to the nearly 9,000,000 people born from 1917 through 1926 and those paid to
5people born before and after them with similar work and earnings records; and
AJR67,1,76 Whereas, individuals born during the "Notch period" served the nation and
7sacrificed during World War II; and
AJR67,1,128 Whereas, House Resolution 97 proposes to amend Title II of the Social Security
9Act to allow workers who attained age 65 after 1981 and before 1992 to choose either
10lump sum payments over 4 years totaling $5,000 or an improved benefit computation
11formula under a new 10-year rule governing the transition to the changes in benefit
12computation rules enacted in the Social Security Amendments of 1977; and
AJR67,2,213 Whereas, in order to save Social Security, Congress passed legislation in 1977
14which changed the way in which benefits were calculated, starting with retirees who

1were born in 1917, resulting in a shortfall in benefits of almost 25% in some
2instances; now, therefore, be it further
AJR67,2,7 3Resolved by the assembly, the senate concurring, That the legislature of
4the state of Wisconsin hereby memorializes Congress to pass legislation to amend
5Title II of the Social Security Act to resolve the disparity between "Notch individuals"
6and others by passing the settlement contained in House Resolution 97, the Notch
7Fairness Act of 2001; and, be it further
AJR67,2,12 8Resolved, That the assembly chief clerk shall provide a copy of this joint
9resolution to the governor of Wisconsin, to each member of the Wisconsin
10congressional delegation, to the President and Vice President of the United States,
11to each member of the President's cabinet, and to the secretary of the U.S. senate and
12the clerk of the U.S. house of representatives.
