SB302,1,5 1An Act to amend 15.373 (2), 35.81 (1), 43.01 (2), 115.43 (1) and 121.845 (2) of the
2statutes; relating to: the name of the division for libraries and community
3learning in the department of public instruction and the definition of minority
4group (suggested as remedial legislation by the department of public
5instruction).

This bill changes the name of the division for libraries and community learning
in the department of public instruction to the division for libraries, technology, and
community learning.
The bill also modifies the definition of "minority group pupil" for the minority
group pupil scholarship program and the special transfer program (commonly
known as chapter 220). The bill deletes "Spanish-surnamed American" and
substitutes "Hispanic"; deletes "Oriental American" and substitutes "person of Asian
or Pacific Island origin"; changes "Black American" to "Black or African American";
and adds "Alaskan native."

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

Law revision committee prefatory note: This bill is a remedial legislation
proposal, requested by the department of public instruction and introduced by the law
revision committee under s. 13.83 (1) (c) 4., stats. After careful consideration of the
various provisions of the bill, the law revision committee has determined that this bill
makes minor substantive changes in the statutes, and that these changes are desirable
as a matter of public policy.
SB302, s. 1 1Section 1. 15.373 (2) of the statutes is amended to read:
SB302,2,42 15.373 (2) Division for libraries, technology, and community learning. There
3is created in the department of public instruction a division for libraries, technology,
4and community learning.
****Note: Sections 1, 2 and 3 of this bill change the name of the "Division for
Libraries and Community Learning" to the "Division for Libraries, Technology, and
Community Learning." According to the department of public instruction, the name of
its "Libraries and Community Learning Division" was changed to the "Division for
Libraries, Technology and Community Learning" in 1998.
SB302, s. 2 5Section 2. 35.81 (1) of the statutes is amended to read:
SB302,2,76 35.81 (1) "Division" means the division for libraries, technology, and
7community learning in the department of public instruction.
SB302, s. 3 8Section 3. 43.01 (2) of the statutes is amended to read:
SB302,2,109 43.01 (2) "Division" means the division for libraries, technology, and
10community learning in the department.
SB302, s. 4 11Section 4. 115.43 (1) of the statutes is amended to read:
SB302,2,1512 115.43 (1) Definition. In this section, "minority group pupil" means a pupil
13who is a Black or African American, an Hispanic, American Indian, a spanish
14surnamed American or an Oriental American
an Alaskan native, or a person of Asian
15or Pacific Island origin

****Note: Sections 4 and 5 of this bill change the definition of "minority group
pupil" in the minority group pupil scholarship program and special transfer program
from "a pupil who is a Black American, a native American, a Spanish-surnamed
American or an Oriental American to "a pupil who is Black or African American,
Hispanic, American Indian, an Alaskan native or a person of Asian or Pacific Island
origin." According to the department of public instruction, the current definition of
"minority pupil" is not consistent with the federal definition of race and ethnicity
categories, and excludes individuals that may be identified as minority students.

1Section 5. 121.845 (2) of the statutes is amended to read:
SB302,3,62 121.845 (2) "Minority group pupil" means a pupil who is a Black or African
3American, a native Hispanic, American , a Spanish-surnamed American or an
4Oriental American
Indian, an Alaskan native, or a person of Asian or Pacific Island
5origin,
and who has reached the age of 4 on or before September 1 of the year he or
6she enters school.
