SB463,1,4 An Act to repeal 4.001 (2) to (5), 4.004 and 4.005; to renumber and amend 4.001 (1); to repeal and recreate 4.002, subchapter II of chapter 4 [precedes 4.009] and subchapter III of chapter 4 [precedes 4.01]; and to create 4.006 and 13.92 (1) (b) 3. e. of the statutes; relating to: legislative redistricting.

Analysis by the Legislative Reference Bureau

This bill redistricts, according to the number of inhabitants, the legislative districts of this state based on the results of the 2000 federal decennial census of population. The bill maintains the number of assembly districts at 99 and the number of senate districts at 33. All assembly districts created by the bill are bounded by county, town, or ward boundaries. In accordance with article IV, section 5, of the state constitution, no assembly district created under the bill is divided in the creation of a senate district. Under the bill, county and municipal boundaries and wards used to create legislative districts are the boundaries and wards in effect on August 1 of the year following the year of the federal decennial census (in this case, August 1, 2001). The boundaries do not account for any municipal annexation, detachment, or consolidation after that date.

Current law requires legislative districts to be substantially equal in population. The table below illustrates, for the assembly and senate districts proposed under the bill, the numeric amount and the percentage by which the districts with the smallest and largest populations deviate from the ideal population for the same type of district. The population figures contained in the table are derived from the results of the federal decennial census. - See PDF for table

This bill also requires the legislative reference bureau, in enrolling any redistricting plan that has passed both houses of the legislature, to attach an updated appendix that includes all of the following: the population statistics for the legislative districts created under the bill; a statewide map of the legislative districts created under the bill; a map of the legislative districts created under the bill that are in Milwaukee County; and, with certain exceptions, a detail map illustrating the division of any city, village, or town among two or more legislative districts.

For further information, see the appendix printed at the end of this bill. The appendix was prepared by the legislative reference bureau and contains the following information: population statistics for the 33 senate districts and the 99 assembly districts, a statewide map of senate districts, a statewide map of assembly districts (displayed over two pages), a map of Milwaukee County showing the assembly district boundaries in that county, and a map of Dane County showing the assembly district boundaries in that county. The population data contained in the appendix is derived from the federal decennial census.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB463, s. 1 Section 1. 4.001 (1) of the statutes is renumbered 4.001 and amended to read:

SB463,2,8 4.001 Legislative redistricting; equal population districts established. Based on the certified official results of the 1980 census of population of Wisconsin, as received by this state from the U.S. bureau of the census on March 23, 1981, under P.L. 94-171, the This state is divided into 33 senate districts, each composed of 3 assembly districts. Each senate district shall be entitled to elect one member of the senate. Each assembly district shall be entitled to elect one representative to the assembly.

SB463, s. 2 Section 2. 4.001 (2) to (5) of the statutes are repealed.

SB463, s. 3 Section 3. 4.002 of the statutes is repealed and recreated to read:

SB463,3,4 4.002 County and municipal boundaries and wards. In this chapter, reference to any county or municipality means that county or municipality as its boundaries exist on August 1 of the year following the federal decennial census on which the districting plans described under subchs. II and III are based.

SB463, s. 4 Section 4. 4.004 of the statutes is repealed.

SB463, s. 5 Section 5. 4.005 of the statutes is repealed.

SB463, s. 6 Section 6. 4.006 of the statutes is created to read:

SB463,3,8 4.006 Definitions. In this chapter:

SB463,3,9 (1) "Block" has the meaning given in s. 5.02 (1q).

SB463,3,12 (2) "Ward" means a municipal ward in effect on August 1 of the year following the federal decennial census on which the districting plans described under subchs. II and III are based.

SB463, s. 7 Section 7. Subchapter II of chapter 4 [precedes 4.009] of the statutes is repealed and recreated to read:

SB463,3,17 Subchapter II Senate districts

SB463,3,19 4.009 Senate districts. (1) First senate district. The combination of the 1st, 2nd, and 3rd assembly districts constitutes the first senate district.

SB463,3,21 (2) Second senate district. The combination of the 4th, 5th, and 6th assembly districts constitutes the 2nd senate district.

SB463,3,23 (3) Third senate district. The combination of the 7th, 8th, and 9th assembly districts constitutes the 3rd senate district.

SB463,3,25 (4) Fourth senate district. The combination of the 10th, 11th, and 12th assembly districts constitutes the 4th senate district.

SB463,4,2 (5) Fifth senate district. The combination of the 13th, 14th, and 15th assembly districts constitutes the 5th senate district.

SB463,4,4 (6) Sixth senate district. The combination of the 16th, 17th, and 18th assembly districts constitutes the 6th senate district.

SB463,4,6 (7) Seventh senate district. The combination of the 19th, 20th, and 21st assembly districts constitutes the 7th senate district.

SB463,4,8 (8) Eighth senate district. The combination of the 22nd, 23rd, and 24th assembly districts constitutes the 8th senate district.

SB463,4,10 (9) Ninth senate district. The combination of the 25th, 26th, and 27th assembly districts constitutes the 9th senate district.

SB463,4,12 (10) Tenth senate district. The combination of the 28th, 29th, and 30th assembly districts constitutes the 10th senate district.

SB463,4,14 (11) Eleventh senate district. The combination of the 31st, 32nd, and 33rd assembly districts constitutes the 11th senate district.

SB463,4,16 (12) Twelfth senate district. The combination of the 34th, 35th, and 36th assembly districts constitutes the 12th senate district.

SB463,4,18 (13) Thirteenth senate district. The combination of the 37th, 38th, and 39th assembly districts constitutes the 13th senate district.

SB463,4,20 (14) Fourteenth senate district. The combination of the 40th, 41st, and 42nd assembly districts constitutes the 14th senate district.

SB463,4,22 (15) Fifteenth senate district. The combination of the 43rd, 44th, and 45th assembly districts constitutes the 15th senate district.

SB463,4,24 (16) Sixteenth senate district. The combination of the 46th, 47th, and 48th assembly districts constitutes the 16th senate district.

SB463,5,2 (17) Seventeenth senate district. The combination of the 49th, 50th, and 51st assembly districts constitutes the 17th senate district.

SB463,5,4 (18) Eighteenth senate district. The combination of the 52nd, 53rd, and 54th assembly districts constitutes the 18th senate district.

SB463,5,6 (19) Nineteenth senate district. The combination of the 55th, 56th, and 57th assembly districts constitutes the 19th senate district.
