13compensation is paid for attendance at those meetings.
AB946,15,1514 7. The period of employment, including the approximate beginning and ending
15dates of employment.
AB946,15,1816 8. A description of the board, lodging, and other facilities to be provided by the
17employer to the individual and any costs to be charged to the individual for those
18facilities.
AB946,15,2219 9. A description of the transportation to be provided by the employer to the
20individual and, if the employment will involve the storage, handling, or
21transportation of hazardous materials or may involve any other exposure to
22hazardous materials, a description of the hazardous materials.
AB946,16,223 10. Whether worker's compensation is provided and, if so, the name and
24telephone number of the employee, agent, or representative of the employer to whom

1notice of a claim for worker's compensation must be provided and the time period
2within which that notice must be provided.
AB946,16,73 (b) An employer of a traveling sales crew worker shall comply with the terms
4of a disclosure statement provided under par. (a). An employer may change the terms
5of a disclosure statement, but no change is effective until a supplemental disclosure
6statement is signed by the employer and the traveling sales crew worker. Any change
7to the terms of a disclosure statement may apply prospectively only.
AB946,16,11 8(6) Payment of compensation; deductions; statements; records. (a) An
9employer shall pay all compensation earned by a traveling sales crew worker on
10regular paydays designated in advance by the employer, but in no case less often than
11semimonthly. Compensation shall be paid in U.S. currency or by check or draft.
AB946,16,2012 (b) An employer may deduct from a traveling sales crew worker's compensation
13the cost to the employer of furnishing board, lodging, or other facilities to the worker
14if the board, lodging, or other facilities are customarily furnished by the employer to
15the traveling sales crew workers of the employer; the amount deducted does not
16exceed the fair market value of the board, lodging, or other facilities and does not
17include any profit to the employer; and the traveling sales crew worker has
18previously authorized the deduction by signing a written disclosure statement under
19sub. (5) (a) that includes a description of the board, lodging, and other facilities to be
20provided and any costs to be charged to the worker for those facilities.
AB946,17,321 (c) An employer shall provide with each payment of compensation to a traveling
22sales crew worker a written statement itemizing the amount of gross and net
23compensation paid to the worker and the amount of and reason for each deduction
24from the amount of gross compensation. An employer shall keep records of the
25information specified in this paragraph with respect to each traveling sales crew

1worker of the employer, shall preserve those records for 3 years after the worker
2leaves the employ of the employer, and shall furnish those records to the department
3on request.
AB946,17,64 (d) A traveling sales crew worker who is owed compensation may file a wage
5claim with the department under s. 109.09 (1) or may bring an action under s. 109.03
6(5) without first filing a wage claim with the department.
AB946,17,14 7(7) Worker safety. (a) An employer of a traveling sales crew worker shall
8maintain and operate, or cause to be maintained and operated, any motor vehicle
9used to transport a traveling sales crew worker in compliance with all state and
10federal safety standards that are applicable to the maintenance and operation of the
11motor vehicle, including any additional safety standards relating specifically to the
12transportation of traveling sales crew workers prescribed by the department by rule
13promulgated under sub. (13). In prescribing those additional safety standards, the
14department shall consider all of the following:

16sales crew workers.
AB946,17,1717 2. The safe passenger-carrying capacity of those motor vehicles.
AB946,17,1918 3. The extent to which a proposed safety standard would cause an undue
19burden to traveling sales crew employers.
AB946,17,2420 4. Any safety standards prescribed by the federal secretary of transportation
21under 49 USC 13101 to 14901, 49 USC 30101 to 30169, and 49 USC 31301 to 31317
22and any other chapter of title 49 of the United States Code that are applicable to the
23maintenance and operation of a motor vehicle that is commonly used to transport
24traveling sales crew workers.
AB946,18,13
1(b) If the duties of a traveling sales crew worker include the storage, handling,
2or transportation of hazardous materials or may result in any other exposure of a
3traveling sales crew worker to hazardous materials, the employer shall ensure that
4the hazardous materials are stored, handled, and transported, and that the traveling
5sales crew worker is trained in the safe storage, handling, and transportation of
6hazardous materials, in accordance with all state and federal safety standards that
7are applicable to the storage, handling, and transportation of hazardous materials
8or to exposure to hazardous materials, including any additional safety standards
9relating specifically to the storage, handling, and transportation of hazardous
10materials by traveling sales crew workers or to the exposure of traveling sales crews
11to hazardous materials prescribed by the department by rule promulgated under
12sub. (13). In prescribing those additional safety standards, the department shall
13consider all of the following:

15sold by traveling sales crews.
AB946,18,1716 2. The extent to which a proposed safety standard would cause an undue
17burden to traveling sales crew employers.
AB946,18,2218 3. Any safety standards prescribed by the federal secretary of transportation
19under 49 USC 5101 to 51237 or by the federal occupational safety and health
20administration under 29 USC 651 to 678 that are applicable to the storage, handling,
21and transportation of hazardous materials by a traveling sales crew worker or to any
22other exposure of a traveling sales crew worker to hazardous materials.
AB946,19,9 23(8) Insurance coverage. The employer of a traveling sales crew worker shall
24have in force a policy of insurance that insures the employer, in an amount prescribed
25by the department by rule promulgated under sub. (13), against liability for damages

1to persons and property arising out of the ownership or operation by the employer
2or by any employee, agent, or representative of the employer of a motor vehicle that
3is used to transport a traveling sales crew worker and a policy of insurance that
4insures the employer, in an amount prescribed by the department by rule
5promulgated under sub. (13), against liability for damages to persons and property
6arising out of any negligent act or omission of the employer or of any employee, agent,
7or representative of the employer. If the employer is required under s. 102.28 (2) to
8provide worker's compensation coverage for its employees, the employer shall also
9provide that coverage.
AB946,19,12 10(9) Prohibited practices. No employer of a traveling sales crew worker and
11no employee, agent, or representative of that employer who supervises or transports
12traveling sales crew workers may do any of the following:
AB946,19,1513 (a) Employ or permit to work as a traveling sales crew worker a person 18 years
14of age or over who has been adjudged incompetent under ch. 880 without the
15permission of the person's guardian or a person under 18 years of age.
AB946,19,1716 (b) Require a traveling sales crew worker to engage in any in-person sales or
17solicitation activities before 9 a.m. or after 9 p.m.
AB946,19,1918 (c) Consider a traveling sales crew worker to be an independent contractor
19rather than an employee.
AB946,19,2220 (d) Require a traveling sales crew worker to purchase any goods or services
21solely from the employer or to pay any of the employer's business expenses, except
22as permitted under sub. (6) (b).
AB946,20,223 (e) Abandon a traveling sales crew worker who is unable to work due to illness
24or injury or who is discharged from employment for reasons other than misconduct

1without providing for the return of the traveling sales crew worker to his or her
2permanent place of residence.
AB946,20,53 (f) Abandon a traveling sales crew worker who has been arrested and is being
4held in custody in connection with a violation of sub. (11) (a) 3. or a local ordinance
5regulating that conduct.
AB946,20,96 (g) Require a traveling sales crew worker to relinquish custody of any of his or
7her personal property to the employer, to any employee, agent, or representative of
8the employer who supervises or transports traveling sales crew workers, or to any
9other traveling sales crew worker of the employer.
AB946,20,1110 (h) Prohibit or restrict a traveling sales crew worker from contacting any family
11member, friend, or other person while traveling with a traveling sales crew.
AB946,20,1412 (i) Intentionally inflict or threaten to inflict any bodily harm on a traveling
13sales crew worker or damage to the property of a traveling sales crew worker as a
14means of discipline or motivation.
AB946,20,1715 (j) Advise or counsel a traveling sales crew worker to make false
16representations to a person to whom he or she is offering goods or services concerning
17his or her motivation for selling those goods or services.
AB946,20,2018 (k) Discharge or discriminate against any person for opposing a practice
19prohibited under this section. Section 111.322 (2m) applies to discharge and other
20discriminatory acts arising in connection with any proceeding under this section.
AB946,21,2 21(10) Child support; delinquent taxes. (a) 1. Except as provided in subd. 3.,
22the department shall require each applicant for a certificate of registration who is
23an individual to provide the department with the applicant's social security number,
24and shall require each applicant for a certificate of registration who is not an
25individual to provide the department with the applicant's federal employer

1identification number, when initially applying for or applying to renew the certificate
2of registration.
AB946,21,93 2. If an applicant who is an individual fails to provide the applicant's social
4security number to the department or if an applicant who is not an individual fails
5to provide the applicant's federal employer identification number to the department,
6the department may not issue or renew a certificate of registration to or for the
7applicant unless the applicant is an individual who does not have a social security
8number and the applicant submits a statement made or subscribed under oath or
9affirmation as required under subd. 3.
AB946,21,1510 3. If an applicant who is an individual does not have a social security number,
11the applicant shall submit a statement made or subscribed under oath or affirmation
12to the department that the applicant does not have a social security number. The
13form of the statement shall be prescribed by the department. A certificate of
14registration issued in reliance upon a false statement submitted under this
15subdivision is invalid.
AB946,21,2116 4. The subunit of the department that obtains a social security number or a
17federal employer identification number under subd. 1. may not disclose the social
18security number or the federal employer identification number to any person except
19to the department of revenue for the sole purpose of requesting certifications under
20s. 73.0301 or on the request of the subunit of the department that administers the
21child and spousal support program under s. 49.22 (2m).
AB946,22,722 (b) The department shall deny, suspend, restrict, refuse to renew, or otherwise
23withhold a certificate of registration for failure of the applicant or registrant to pay
24court-ordered payments of child or family support, maintenance, birth expenses,
25medical expenses, or other expenses related to the support of a child or former spouse

1or for failure of the applicant or registrant to comply, after appropriate notice, with
2a subpoena or warrant issued by the department or a county child support agency
3under s. 59.53 (5) and related to paternity or child support proceedings, as provided
4in a memorandum of understanding entered into under s. 49.857. Notwithstanding
5s. 103.005 (10), an action taken under this paragraph is subject to review only as
6provided in the memorandum of understanding entered into under s. 49.857 and not
7as provided in ch. 227.
AB946,22,138 (c) The department shall deny an application for the issuance or renewal of a
9certificate of registration, or revoke a certificate of registration already issued, if the
10department of revenue certifies under s. 73.0301 that the applicant or registrant is
11liable for delinquent taxes. Notwithstanding s. 103.005 (10), an action taken under
12this paragraph is subject to review only as provided under s. 73.0301 (5) and not as
13provided in ch. 227.
AB946,22,22 14(11) Traveling sales crew worker permits. (a) 1. No individual may be
15employed or permitted to work as a traveling sales crew worker unless the employer
16of the individual first obtains from the department a traveling sales crew worker
17permit for the individual as provided in this paragraph, and the individual first
18obtains from the department an identification card as provided in this paragraph.
19The traveling sales crew worker permit and identification card shall be in a form
20prescribed by the department, which form shall include at a minimum the name and
21permanent home address of the traveling sales crew worker and the name, address,
22and phone number of his or her employer.
AB946,23,423 2. An employer of a traveling sales crew worker and all employees, agents, or
24representatives of that employer who supervise or transport traveling sales crew
25workers shall carry at all times while engaged in traveling sales crew activities a

1copy of the permit obtained under subd. 1. for each traveling sales crew worker of the
2employer and shall exhibit that copy upon the request of any deputy of the
3department, law enforcement officer, or person with whom the employer, employee,
4agent, or representative is doing business.
AB946,23,95 3. A traveling sales crew worker shall carry at all times while engaged in
6traveling sales crew activities the identification card obtained under subd. 1. and
7shall exhibit that card upon the request of any deputy of the department, law
8enforcement officer, or person with whom the traveling sales crew worker is doing
9business.
AB946,23,1210 4. Failure to exhibit a copy of a permit upon request under subd. 2. or an
11identification card upon request under subd. 3. is prima facie evidence of a violation
12of this section.
AB946,23,1313 (b) A traveling sales crew employer shall do all of the following:
AB946,23,1714 1. Keep a copy of the permit obtained under par. (a) 1. for each traveling sales
15crew worker of the employer for at least 3 years after the traveling sales crew worker
16leaves the employ of the employer and allow the department to inspect those permits
17upon request.
AB946,23,2018 2. Keep a list of the names of all cities, villages, or towns where traveling sales
19crew workers of the employer engaged in traveling sales crew activities within the
20last 3 years and allow the department to inspect that list upon request.
AB946,23,2321 3. At the request of the department, provide a list of all cities, villages, or towns
22where the employer intends to employ traveling sales crew workers in traveling sales
23crew activities for the 6-month period beginning on the date of the request.
AB946,24,524 (c) Before an employer may permit a traveling sales crew worker of the
25employer to engage in traveling sales crew activities in any city, village, or town, the

1employer shall obtain from the clerk of the city, village, or town a stamp or
2endorsement on the permit obtained under par. (a) 1. of the traveling sales crew
3worker. When an employer obtains that stamp or endorsement, the employer shall
4provide notice that traveling sales crew workers of the employer will be engaging in
5traveling sales crew activities in that city, village, or town to the following:
AB946,24,76 1. The local police department, if the city, village, or town has a police
7department.
AB946,24,98 2. To the sheriff of the county where the city, village, or town is located, if the
9city, village, or town does not have a police department.
AB946,24,1410 (d) Law enforcement officers of counties, cities, villages, and towns shall assist
11the department in enforcing this section by questioning individuals seen engaging
12in traveling sales crew activities and reporting to the department all cases of
13individuals apparently engaging in traveling sales crew activities in violation of this
14section.
AB946,24,25 15(12) Penalties; enforcement. (a) Any person that engages in traveling sales
16crew activities in violation of this section, any rule promulgated under sub. (13), or
17any order issued under this section, that employs or permits the employment of any
18individual as a traveling sales crew worker in violation of this section, any rule
19promulgated under sub. (13), or any order issued under this section, or that hinders
20or delays the department or any law enforcement officer in the performance of their
21duties under this section, may be required to forfeit not less than $25 nor more than
22$1,000 for each day of a first offense and, for a 2nd or subsequent offense within 5
23years, as measured from the dates the violations initially occurred, may be fined not
24less than $250 nor more than $5,000 for each day of the 2nd or subsequent offense
25or imprisoned not more than 30 days or both.

1(b) In addition to the penalties under par. (a), any person that employs or
2permits the employment of any individual as a traveling sales crew worker in
3violation of sub. (2), (5) (b), (9) (b), or (11) (a) or (c) shall be liable, in addition to the
4wages paid, to pay to each individual affected, an amount equal to twice the regular
5rate of pay as liquidated damages for all hours worked in violation per day or per
6week, whichever is greater.
AB946,25,97 (c) The department may refer violations of this section or of any rules
8promulgated under sub. (13) for prosecution by the department of justice or the
9district attorney of the county in which the violation occurred.
AB946,25,11 10(13) Rules. The department shall promulgate rules to implement this section.
11Those rules shall include all of the following:
AB946,25,1312 (a) A fee for obtaining a certificate of registration. The department shall
13determine the fee based on the cost of issuing certificates of registration.
AB946,25,1414 (b) Minimum requirements for the issuance of a certificate of registration.
AB946,25,1915 (c) Safety standards relating to the transportation of traveling sales crew
16workers, the storage, handling, and transportation of hazardous materials by
17traveling sales crews and any other exposure of a traveling sales crew worker to
18hazardous materials, and the training of traveling sales crews in the storage,
19handling, and transportation of hazardous materials.
AB946,25,2120 (d) The amount of liability insurance that an employer of a traveling sales crew
21worker shall have in force under sub. (8).
AB946,25,25 22(14) Nonapplicability; nonpreemption. (a) This section does not apply to the
23employment of a person in a fund-raising sale for a nonprofit organization, as
24defined in s. 103.21 (2), a public school, as defined in s. 103.21 (5), or a private school,
25as defined in s. 103.21 (4).

1(b) This section does not preempt a county, city, village, or town from enacting
2a local ordinance regulating traveling sales crew activities. To the extent that a local
3ordinance regulates conduct that is regulated under this section, the local ordinance
4shall be at least as strict as the regulation of that conduct under this section.
