AB388,1,3 1An Act to create 15.157 (13), 20.143 (1) (fr) and 560.085 of the statutes; relating
2to:
establishing a state waterfront development program and creating a council
3on that program.

This bill requires the Department of Commerce (department) to establish and
administer a state waterfront development program, entitled the
"On-the-waterfront Program," for the purpose of assisting cities, villages, and towns
(municipalities) to coordinate, plan, manage, and implement programs for the
revitalization of areas that are adjacent to lakes or streams. Revitalization includes
constructing, renovating, and rehabilitating buildings or other improvements to
increase economic activity and tourism. Under the program, the department must
provide technical assistance, training, and information on revitalization of
waterfront areas to municipalities, and must coordinate state grant programs that
are available to municipalities for waterfront development. The authorized
positions for the department are increased by one for administration of the program.
The bill also creates the On-the-waterfront Program Council (council), which
is made up of the secretaries of commerce, tourism, natural resources, and
transportation, or their designees, and representatives of a local chamber of
commerce, a local visitor and convention bureau, a city, village, or county, a town, the
planning profession, the financial community, and the business community. The
council is charged with helping the secretary of commerce to develop a plan to operate
the On-the-waterfront Program, reviewing the effectiveness of the program, and
recommending procedures to improve the program.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB388, s. 1 1Section 1. 15.157 (13) of the statutes is created to read:
AB388,2,72 15.157 (13) On-the-waterfront program council. (a) There is created in the
3department of commerce an on-the-waterfront program council, consisting of the
4secretary of commerce or his or her designee, the secretary of tourism or his or her
5designee, the secretary of natural resources or his or her designee, the secretary of
6transportation or his or her designee, and the following members appointed for
73-year terms:

11organization.

AB388,3,5 5560.085 On-the-waterfront Program. (1) In this section:
AB388,3,66 (a) "Municipality" means a city, village, or town.
AB388,3,97 (b) "Revitalization" means any work or undertaking by a municipality to
8construct, reconstruct, renovate, or rehabilitate buildings, structures, or other
9improvements at a site or facility to increase economic activity and tourism.
AB388,3,1010 (c) "Waterfront area" means an area located adjacent to a lake or stream.
AB388,3,15 11(2) The department shall establish and administer a state waterfront
12development program, entitled the "On-the-waterfront Program," to assist
13municipalities in coordinating, planning, managing, and implementing programs
14for the revitalization of waterfront areas. The department shall do all of the
15following:
AB388,3,1716 (a) Employ, in the state classified service, staff for the On-the-waterfront
17Program.
AB388,3,2018 (b) Coordinate state programs for grants that are available to municipalities
19for waterfront development, including transportation enhancement activities
20program grants and grants from the department.

1(c) Provide to municipalities technical assistance, training, and information on
2the revitalization of waterfront areas.
AB388,4,63 (d) With assistance from the on-the-waterfront program council and from
4interested individuals and organizations, develop a plan describing the objectives of
5the On-the-waterfront Program and the methods by which the department shall
6accomplish the duties under pars. (b) and (c).
AB388,4,7 7(3) The on-the-waterfront program council shall do all of the following
AB388,4,98 (a) Help the secretary to develop a plan to operate the On-the-waterfront
9Program.
AB388,4,1110 (b) Review the effectiveness of, and recommend to the secretary procedures to
11improve, the On-the-waterfront Program.
AB388, s. 5 12Section 5. Nonstatutory provisions.
AB388,4,1613 (1) On-the-waterfront program council. Notwithstanding the length of
14terms specified for the members of the on-the-waterfront program council under
15section 15.157 (13) (a) (intro.) of the statutes, as created by this act, the initial
16members shall be appointed for the following terms:
AB388,4,1817 (a) The members specified under section 15.157 (13) (a) 1. to 4. of the statutes,
18as created by this act, for terms expiring on July 1, 2008.
AB388,4,2019 (b) The members specified under section 15.157 (13) (a) 5. to 7. of the statutes,
20as created by this act, for terms expiring on July 1, 2009.
AB388,4,2421 (2) Position authorization. The authorized FTE positions for the department
22of commerce are increased by 1.0 GPR position, to be funded from the appropriation
23under section 20.143 (1) (fr) of the statutes, as created by this act, for the purpose of
24administering the On-the-waterfront Program.
