AB779,2,1110 (d) "Student" means an individual who is enrolled in an institution of higher
11learning on a full-time basis, as determined by the institution of higher learning.
AB779,3,2 12(2) Organization and purpose. (a) Notwithstanding s. 185.02, student health
13benefit purchasing cooperatives may be organized under this chapter in each of the
14geographic areas designated under sub. (6). Notwithstanding s. 185.043, a student
15health benefit purchasing cooperative may be formed by one or more persons.
16Notwithstanding s. 185.05 (1) (m), the articles of a student health benefit purchasing

1cooperative shall set forth the name and address of at least one incorporator who will
2act as the temporary board.
AB779,3,73 (b) The purpose of a student health benefit purchasing cooperative is to provide
4health care benefits for the individuals specified in sub. (4) (a) 1. to 3., under a single
5group health care policy or plan through a contract between the student health
6benefit purchasing cooperative and an insurer authorized to do business in this state
7in one or more lines of insurance that includes health insurance.
AB779,3,98 (c) A student health benefit purchasing cooperative shall be designed so that
9all of the following are accomplished:
AB779,3,1110 1. The members and employees of the cooperative become better informed
11about health care trends and cost increases.
AB779,3,1312 2. All members receive their health care benefits under the group health care
13policy or plan negotiated under sub. (4) (a).
AB779,3,1514 3. The members are actively engaged in designing health care benefit options
15that are offered by the insurer and that meet the needs of their community.
AB779,3,1716 4. The health insurance risk of all of the members and employees who receive
17coverage is pooled.
AB779,3,1918 5. The members actively participate in health improvement decisions for their
19community.
AB779,3,22 20(3) Cooperative membership. (a) Notwithstanding s. 185.11 (1), each student
21health benefit purchasing cooperative shall be organized on a membership basis
22with no capital stock.
AB779,3,2423 (b) Any student who satisfies all of the following criteria may be a member of
24a student health benefit purchasing cooperative:

11. The student has resided in this state for at least 12 months when he or she
2applies for membership.
AB779,4,43 2. The student resides in the geographic area in which the student health
4benefit purchasing cooperative is organized.
AB779,4,65 3. The student meets the membership criteria established by the student
6health benefit purchasing cooperative in its bylaws.
AB779,4,87 4. The student agrees to remain a member of the student health benefit
8purchasing cooperative for at least one year.
AB779,4,99 5. The student pays the membership fee.
AB779,4,1310 (c) A student health benefit purchasing cooperative may impose a penalty
11against a member who withdraws from the student health benefit purchasing
12cooperative before the end of the year to which the student has agreed under par. (b)
134.
AB779,4,1614 (d) Each student health benefit purchasing cooperative shall file its
15membership criteria, as well as any amendments to the criteria, with the
16commissioner.
AB779,4,23 17(4) Health care benefits; eligibility. (a) The health care benefits offered by
18a student health benefit purchasing cooperative shall be negotiated between the
19student health benefit purchasing cooperative and the insurer and shall be offered
20in a single group health care policy or plan. The contract between the student health
21benefit purchasing cooperative and the insurer shall be for a term of 3 years. The
22insurer must offer coverage under the group health care policy or plan to all of the
23following:

25cooperative.

12. An employee of the student health benefit purchasing cooperative.
AB779,5,32 3. A dependent of a student under subd. 1., or of an employee under subd. 2.,
3who receives coverage.
AB779,5,94 (b) Notwithstanding par. (a) 1. and 3. and subs. (2) (b) and (3) (b), a student
5receiving coverage through a student health benefit purchasing cooperative who
6would lose eligibility for membership and coverage because he or she is no longer
7enrolled in an institution of higher learning on a full-time basis may continue to be
8a member and to receive coverage for himself or herself and his or her dependents
9for up to 6 months after he or she loses eligibility.
AB779,5,12 10(5) Required reports. Each student health benefit purchasing cooperative
11shall submit to the legislature under s. 13.172 (2) and to the commissioner all of the
12following:
AB779,5,1513 (a) Annually, no later than September 30, a report on the progress of the
14student health benefit purchasing arrangement described in this section and, to the
15extent possible, any significant findings in the criteria under par. (b) 1. to 3.
AB779,5,1916 (b) Within one year after the end of the term of the contract between the student
17health benefit purchasing cooperative and the insurer, a final report that details
18significant findings from the project and that includes, at a minimum, to the extent
19available, information on all of the following:
AB779,5,2120 1. The extent to which the student health benefit purchasing arrangement had
21an impact on the number of uninsured in the geographic area in which it operated.
AB779,5,2422 2. The effect on health care coverage premiums for groups in the geographic
23area in which the student health benefit purchasing arrangement operated,
24including groups other than the student health benefit purchasing cooperative.

13. The degree to which health care consumers were involved in the
2development and implementation of the student health benefit purchasing
3arrangement.
AB779,6,8 4(6) Designation of geographic areas. After consultation with the Wisconsin
5Federation of Cooperatives, the commissioner shall designate, by order, the
6geographic areas of the state in which student health benefit purchasing
7cooperatives may be organized. A geographic area may overlap with one or more
8other geographic areas.
AB779,6,14 9(7) Insurer status as small employer insurer. An insurer that contracts under
10this section with a student health benefit purchasing cooperative that provides
11health care benefits for more than 50 individuals who are members or employees of
12the cooperative is not a small employer insurer, as defined in s. 635.02 (8), with
13respect to the contract between the insurer and the student health benefit
14purchasing cooperative.
