10111 and chapter 230 of the statutes in the department of administration that they
11enjoyed in their respective state agencies immediately before the transfer.
12Notwithstanding section 230.28 (4) of the statutes, no employee so transferred who
13has attained permanent status in class is required to serve a probationary period.
SB40,1712,1814 (f) Materials. On the effective date of this paragraph, all equipment, supplies,
15and furniture required for the provision of legal services by employees transferred
16under paragraphs (b) and (c) are transferred to the department of administration.
17The secretary of administration shall identify the equipment, supplies, and

20children and families shall rate the quality of the child care provided by all child care
21providers that, on that date, hold a license under section 48.65 of the statutes and

23affected by this act, as required under section 48.658 of the statutes, as created by
24this act.

1(1m) Indian child high-cost out-of-home care placement funding.
2Notwithstanding section 16.54 (12) (b) of the statutes, as affected by Section 95 of
3this act, and section 48.567 (1) and (2) of the statutes, as created by this act, in fiscal
4year 2008-09 the department of children and families may expend not more than
5$500,000 in moneys received in fiscal year 2006-07 or 2007-08 and credited to the
6appropriation accounts under section 20.437 (3) (mm) or (mp) of the statutes, as
7created by this act, less any moneys expended under section 9121 (1m) of this act for
8unexpected or unusually high-cost out-of-home care placements of Indian children
9by tribal courts. The department of children and families may expend moneys under
10this subsection only if that department determines in light of overall child welfare
11needs and after paying federal disallowances under section 20.437 (3) (mm) of the
12statutes, as created by this act, that there are sufficient moneys in the appropriation
13accounts under section 20.437 (3) (mm) and (mp) of the statutes, as created by this
14act, to expend for that purpose.
SB40,1713,18 15(3) Initial terms of board members. Notwithstanding the lengths of terms of
16the members of the board of directors of the Healthy Wisconsin Authority specified
17in section 238.05 (1) (intro.) of the statutes, as created by this act, the initial members
18shall be appointed for the following terms:

20as created by this act, for terms that expire on July 1, 2009.

1(4) Provisional appointments of board members. Notwithstanding the
2requirement for senate confirmation of the appointment of the members of the board
3of directors of the Healthy Wisconsin Authority under section 238.05 (1) (e) of the
4statutes, as created by this act, the initial members may be provisionally appointed
5by the governor, subject to confirmation by the senate. Any such appointment shall
6be in full force until acted upon by the senate, and when confirmed by the senate shall
7continue for the remainder of the term, or until a successor is chosen and qualifies.
8A provisional appointee may exercise all of the powers and duties of the office to
9which such person is appointed during the time in which the appointee qualifies.
10Any appointment made under this subsection that is withdrawn or rejected by the
11senate shall lapse. When a provisional appointment lapses, a vacancy occurs.
12Whenever a new legislature is organized, any appointments then pending before the
13senate shall be referred by the president to the appropriate standing committee of
14the newly organized senate.
