SB162,1,3 1An Act to amend 343.50 (4); to repeal and recreate 343.50 (4); and to create
2343.14 (2) (j) of the statutes; relating to: notice of the fee for identification
3cards issued by the Department of Transportation.
Analysis by the Legislative Reference Bureau
Under current law, as created in 2011 Wisconsin Act 23, the Department of
Transportation (DOT) may not charge a fee to an applicant for the initial issuance,
renewal, or reinstatement of an identification card if the applicant is a U.S. citizen
who will be at least 18 years of age on the date of the next election and the applicant
requests that the identification card be provided without charge for purposes of
voting.
This bill requires DOT to include, on application forms for identification cards,
a statement that there is no fee for the initial issuance, renewal, or reinstatement
of an identification card if the applicant is a U.S. citizen who will be at least 18 years
of age on the date of the next election and the applicant requests that the
identification card be provided without charge for purposes of voting. In addition,
DOT must advise any person inquiring about issuance of an identification card that
identification cards may be available without charge for purposes of voting.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 343.14 (2) (j) of the statutes is created to read:
SB162,2,82 343.14 (2) (j) For an identification card, a statement that there is no fee for the
3initial issuance, renewal, or reinstatement of an identification card if the applicant
4is a U.S. citizen who will be at least 18 years of age on the date of the next election
5and the applicant requests that the identification card be provided without charge
6for purposes of voting. In addition to this statement on the application form, the
7department shall advise any person inquiring about issuance of an identification
8card that identification cards may be available without charge for purposes of voting.
SB162, s. 2 9Section 2. 343.50 (4) of the statutes, as affected by 2011 Wisconsin Act 23,
10section 134, and 2011 Wisconsin Act 32, section 3177, is amended to read:
SB162,2,1911 343.50 (4) Application. The application for an identification card shall include
12any information required under ss. 85.103 (2) and 343.14 (2) (a), (b), (bm), (br), (em),
13and (er), and (j), and such further information as the department may reasonably
14require to enable it to determine whether the applicant is entitled by law to an
15identification card. Except with respect to renewals by mail or electronic means as
16authorized under sub. (6), and except as provided in sub. (4g), the department shall,
17as part of the application process for original issuance or renewal of an identification
18card, take a photograph of the applicant to comply with sub. (3). Misrepresentations
19in violation of s. 343.14 (5) are punishable as provided in s. 343.14 (9).

SB162,3,723 343.50 (4) Application. The application for an identification card shall include
24any information required under ss. 85.103 (2) and 343.14 (2) (a), (b), (bm), (br), (em),
25(es), and (j), and such further information as the department may reasonably require

1to enable it to determine whether the applicant is entitled by law to an identification
2card. Except with respect to renewals described in s. 343.165 (4) (d) or renewals by
3mail or electronic means as authorized under sub. (6), and except as provided in sub.
4(4g), the department shall, as part of the application process for original issuance or
5renewal of an identification card, take a digital photograph including facial image
6capture of the applicant to comply with sub. (3). Misrepresentations in violation of
7s. 343.14 (5) are punishable as provided in s. 343.14 (9).
SB162, s. 4 8Section 4. Effective dates. This act takes effect on the day after publication,
9except as follows:
SB162,3,1210 (1) The repeal and recreation of section 343.50 (4) of the statutes takes effect
11on the day after publication, or on the date on which the creation of section 343.165
12of the statutes by 2007 Wisconsin Act 20 takes effect, whichever is later.
