SB689,1,3 1An Act to create 101.659 of the statutes; relating to: the applicability of laws
2regulating the construction of one- and two-family dwellings to dwellings that
3are occupied by members of certain bona fide religious denominations.
Analysis by the Legislative Reference Bureau
Under current law, any one- or two-family dwelling for which initial
construction began on or after December 1, 1978, must comply with the one- and
two-family dwelling code and other statutory requirements that apply to such
dwellings. Under current law, the Department of Safety and Professional Services
promulgates rules implementing this code, which includes standards for
construction, heating, and ventilation. The state electrical and plumbing codes
promulgated by DSPS are incorporated by reference into this dwelling code. One-
and two-family dwellings for which initial construction began before December 1,
1978 are not covered by these statutes or the dwelling code but are covered by the
state electrical and plumbing codes.
Under this bill, an owner or occupant of a one- or two-family dwelling is exempt
from complying with any provision of a statute or rule that applies to one- and
two-family dwellings if all of the occupants of the dwelling are members of a bona
fide religious denomination that, as part of its teachings or beliefs, prohibits
compliance with the provision.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

4promulgated under this subchapter, with the state electrical and plumbing codes,
5and with any other rule promulgated under this chapter that applies to one- or
62-family dwellings if all of the occupants of the dwelling are members of a bona fide
7religious denomination that, as part of its teachings or beliefs, prohibits compliance
8with the provision, code, or rule.
