AB360,1,3 An Act to create 301.51, 941.23 (2) (f), 941.235 (2) (b) and 941.237 (3) (bm) of the statutes; relating to: persons charged with locating persons who abscond from parole, probation, and extended supervision and going armed with a firearm.

Analysis by the Legislative Reference Bureau

This bill allows a probation, extended supervision, or parole agent whose primary duty is to locate individuals who have absconded from probation, extended supervision, or parole to go armed with a concealed firearm and to go armed in a public building and on the premises of a tavern. This bill also requires the Department of Corrections to provide the person with credentials and a badge and requires the person to carry the credentials and badge while on duty.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB360,1 Section 1. 301.51 of the statutes is created to read:

AB360,1,8 301.51 Identification for persons who locate absconders. (1) In this section, "absconder agent" means a probation, extended supervision, or parole agent whose primary duty is to locate individuals who have absconded from probation, extended supervision, or parole.

AB360,2,6 (2) The department shall issue credentials and a badge to each absconder agent, and an absconder agent shall carry them at all times while on duty. The department shall select the type of firearm an absconder agent may carry if the absconder agent carries a firearm. The department shall provide absconder agents with training regarding firearm safety and use and shall provide absconder agents with the ammunition needed to perform their duty.

AB360,2 Section 2. 941.23 (2) (f) of the statutes is created to read:

AB360,2,9 941.23 (2) (f) An absconder agent, as defined in s. 301.51 (1), who is going armed with a firearm while acting in his or her official capacity.

AB360,3 Section 3. 941.235 (2) (b) of the statutes is created to read:

AB360,2,12 941.235 (2) (b) An absconder agent, as defined in s. 301.51 (1), who is going armed while acting in his or her official capacity.

AB360,4 Section 4. 941.237 (3) (bm) of the statutes is created to read:

AB360,2,15 941.237 (3) (bm) An absconder agent, as defined in s. 301.51 (1), who is going armed while acting in his or her official capacity.
