SB486,1,4 1An Act to amend 60.75 (1) (a), 60.75 (2) (a) and 60.75 (2) (b); and to create 60.10
2(2) (m) and 60.75 (2) (bm) of the statutes; relating to: authorizing a town
3meeting to direct a town board to change the number of commissioners of
4certain town sanitary district commissions.
Analysis by the Legislative Reference Bureau
This bill authorizes a town meeting to direct a town board to increase the
number of commissioners on a town sanitary district commission from three to five
if the commission is separate from the town board. The bill also authorizes a town
meeting to direct a town board to decrease the number of commissioners on a town
sanitary district commission from five to three if the commission is separate from the
town board, although the town meeting may not direct a town board to change the
number of commissioners more frequently than every two years. If a town board
performs the functions of a town sanitary district commission, the membership of the
commission remains the same as the membership of the town board.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB486,1 5Section 1. 60.10 (2) (m) of the statutes is created to read:

160.10 (2) (m) Membership of town sanitary district commission. If the town
2board does not constitute itself as the town sanitary district commission, direct the
3town board to increase the membership of the town sanitary district commission
4under subch. IX from 3 members to 5 members, or direct the town board to decrease
5the membership of the town sanitary district commission from 5 members to 3
6members, except that the town meeting may not act under this paragraph more
7frequently than every 2 years. If a town meeting directs the town board to decrease
8the membership of the town sanitary district commission, the reduction in members
9first applies upon the expiration of the terms of the first 2 commissioners whose
10terms expire at the same time after the town meeting directs the town board to
11reduce the number of commissioners.
SB486,2 12Section 2. 60.75 (1) (a) of the statutes is amended to read:
SB486,2,1413 60.75 (1) (a) Except as provided in par. (b), the commission shall consist of 3
14or 5 members.
SB486,3 15Section 3. 60.75 (2) (a) of the statutes is amended to read:
SB486,2,1716 60.75 (2) (a) Except as provided in pars. (b), (bm), and (c), commissioners shall
17serve for staggered 6-year terms.
SB486,4 18Section 4. 60.75 (2) (b) of the statutes is amended to read:
SB486,3,219 60.75 (2) (b) Except as provided under par. (c), of the commissioners in a district
20in which the town board changes the number of commissioners from 5 to 3 or of the
21commissioners
first appointed or elected in a newly established town sanitary
22district, which consists of 3 members, one shall be appointed or elected for a term of
232 years, one for a term of 4 years and one for a term of 6 years. If the commissioners
24first elected in a newly established town sanitary district are elected at a special

1election, the town board shall specify shorter staggered terms for the commissioners
2so that their successors may be elected at a regular spring election.
SB486,5 3Section 5. 60.75 (2) (bm) of the statutes is created to read:
SB486,3,114 60.75 (2) (bm) Except as provided under par. (c), of the commissioners in a
5district in which the town board changes the number of commissioners from 3 to 5
6or of the commissioners first appointed or elected in a newly established town
7sanitary district, which consists of 5 members, 2 shall be appointed or elected for a
8term of 2 years, 2 for a term of 4 years, and one for a term of 6 years. If the
9commissioners described in this paragraph are first elected at a special election, the
10town board shall specify shorter staggered terms for the commissioners so that their
11successors may be elected at a regular spring election.
