AB223,1,4 An Act to renumber 19.45 (13) and 19.59 (1) (br); and to create 19.45 (13) (b) and 19.59 (1) (br) 2. of the statutes; relating to: offering employment in exchange for not seeking an elective state or local office and providing a criminal penalty.

Analysis by the Legislative Reference Bureau

This bill prohibits a state or local public official or candidate to offer employment to another individual in order to induce the individual not to seek election to the same office held by the official or sought by the candidate. The bill also prohibits an individual from accepting any such offer. Current law, generally, prohibits a state or local public official or candidate for a state or local public office from receiving anything of value in exchange for taking or refraining from taking any official action on any proposed or pending matter.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB223,1 Section 1. 19.45 (13) of the statutes is renumbered 19.45 (13) (a).

AB223,2 Section 2. 19.45 (13) (b) of the statutes is created to read:

AB223,2,5 19.45 (13) (b) No state public official or candidate may, directly or by means of an agent, provide, or offer or promise to provide, employment to another individual in order to induce the individual not to seek election to the same state public office held by the official or sought by the candidate, and no individual may accept such an offer or promise.

AB223,3 Section 3 . 19.59 (1) (br) of the statutes is renumbered 19.59 (1) (br) 1.

AB223,4 Section 4 . 19.59 (1) (br) 2. of the statutes is created to read:

AB223,2,12 19.59 (1) (br) 2. No local public official or candidate may, directly or by means of an agent, provide, or offer or promise to provide, employment to another individual in order to induce the individual not to seek election to the same local public office held by the official or sought by the candidate, and no individual may accept such an offer or promise.
