relating to: work release for inmates in
3Department of Corrections contracted facilities.

This bill permits inmates confined in county jails, county houses of correction,
or tribal jails under a Department of Corrections contract with a local unit of
government to leave the facility to participate in employment-related activities or
any other activity that has been designated by DOC in its contract with the local unit
of government.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

2. 302.27 of the statutes is renumbered 302.27 (1) and amended to

(1) The department may contract with
a local
governments unit of
6government, as defined in s. 16.957 (1) (k), for temporary housing or detention in
7county jails
or, county houses of correction
, or tribal jails for persons placed on
8probation or sentenced to imprisonment in state prisons or to the intensive sanctions
9program. The rate under any such contract may not exceed $60 per person per day.
10Nothing in this
section subsection limits the authority of the department to place
11persons in jails under s. 301.048 (3) (a) 1.

3. 302.27 (2) of the statutes is created to read:

(2) Inmates who are confined or detained under sub. (1) may be granted
14the privilege of leaving the facility during necessary and reasonable hours to engage
15in employment-related activities including seeking employment, engaging in
16employment training, working at employment, performing community service work,
17or attendance at an educational institution, or for any other activity designated in
18the contract under sub. (1). The sheriff or tribal chief of police, in conjunction with
19the department, shall determine inmate eligibility to participate in such activities
20and may terminate participation or return an inmate to state facilities, or both, at
21any time.
