AB821,1,2 1An Act to create 36.27 (2) (cr) of the statutes; relating to: a University of
2Wisconsin System nonresident tuition exemption.
Analysis by the Legislative Reference Bureau
This bill creates a nonresident tuition exemption for certain University of
Wisconsin System students. Current law allows the Board of Regents of the UW
System to charge different tuition rates to resident and nonresident students.
Current law also includes nonresident tuition exemptions, under which certain
nonresident students pay resident tuition rates. This bill creates an additional
exemption for a person who has resided in this state for 12 months immediately
preceding any semester or session in which they register at an institution and who
is in approved deferred action status pursuant to the U.S. Department of Homeland
Security's Deferred Action for Childhood Arrivals (DACA) program.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB821,1 3Section 1. 36.27 (2) (cr) of the statutes is created to read:
AB821,1,54 36.27 (2) (cr) A person is entitled to the exemption under par. (a) if that person
5meets all of the following requirements:

11. The person has resided in this state for 12 months immediately preceding
2the beginning of any semester or session in which the person registers at an
3institution.
AB821,2,64 2. The person is in approved deferred action status pursuant to the deferred
5action for childhood arrivals program of the federal department of homeland
6security.
AB821,2 7Section 2. Initial applicability.
AB821,2,98 (1) This act first applies to persons who enroll for the semester or session
9following the effective date of this subsection.
