ASSEMBLY SUBSTITUTE AMENDMENT 1,
TO 2009 ASSEMBLY BILL 19

AB19-ASA1,1,3 1An Act to amend 218.0161; and to create 100.58 and 218.0146 (5) of the
2statutes; relating to: requiring certain motor vehicle radios to include weather
3radio systems and providing a penalty.
Analysis by the Legislative Reference Bureau
This substitute amendment prohibits any person in the business of selling or
installing vehicle radios from selling or installing a vehicle radio manufactured after
January 1, 2011, unless the vehicle radio includes a weather radio system. The
substitute amendment also prohibits motor vehicle dealers from selling or offering
for sale new motor vehicles manufactured after January 1, 2011, that are equipped
with vehicle radios unless the vehicle radios include weather radio systems. A
person who violates either of these prohibitions is subject to a forfeiture not
exceeding $200.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB19-ASA1, s. 1 4Section 1. 100.58 of the statutes is created to read:
AB19-ASA1,1,5 5100.58 Weather radios in motor vehicles. (1) In this section:
AB19-ASA1,2,5
1(a) "Vehicle radio" means a radio designed to be installed or mounted in a motor
2vehicle for the purpose of receiving broadcasts to the general public or to fee-paying
3subscribers to a network, but does not include any radio designed to be used for
4amateur radio communications under a license issued by the federal
5communications commission.
AB19-ASA1,2,106 (b) "Weather radio system" means a receiver or scanner that is capable of
7receiving weather-related emergency broadcasts and that complies with the
8Consumer Electronics Association standard for consumer electronic products
9designed to receive all hazard alert signals broadcast by the national oceanic and
10atmospheric administration's weather radio network.
AB19-ASA1,2,13 11(2) No person in the business of selling or installing vehicle radios may sell or
12install in this state a vehicle radio manufactured after January 1, 2011, unless the
13vehicle radio includes a weather radio system.
AB19-ASA1, s. 2 14Section 2. 218.0146 (5) of the statutes is created to read:
AB19-ASA1,2,1915 218.0146 (5) A person required to be licensed under this chapter may not sell
16or offer for sale a new motor vehicle manufactured after January 1, 2011, that is
17equipped with a vehicle radio, as defined in s. 100.58 (1) (a), unless the vehicle radio
18includes a weather radio system, as defined in s. 100.58 (1) (b). Any person who
19violates this subsection may be required to forfeit not more than $200.
AB19-ASA1, s. 3 20Section 3. 218.0161 of the statutes is amended to read:
AB19-ASA1,2,24 21218.0161 Penalties. Except for s. 218.0116 (1) (a), (b), (cm), (d), (f), (fm), (g),
22(jm), (m), (o) and (om), and except for violations for s. 218.0114 (1), 218.0119,
23218.0146 (5), or 218.0147, any person violating ss. 218.0101 to 218.0163 may be
24required to forfeit not less than $25 nor more than $500 for each violation.
