ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 2009 ASSEMBLY BILL 29

AB29-ASA1,1,2 An Act to create 947.014 of the statutes; relating to: use of radio frequency identification tags to facilitate a crime and providing penalties.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB29-ASA1, s. 1 Section 1. 947.014 of the statutes is created to read:

AB29-ASA1,1,6 947.014 Unlawful use of radio frequency identification tag. (1) In this section, "radio frequency identification tag" means a device encoded with a unique serial number that receives or transmits a signal over radio waves.

AB29-ASA1,1,8 (2) No person may use a radio frequency identification tag with intent to facilitate the commission of a crime.

AB29-ASA1,1,9 (3) A person who violates sub. (2) is guilty of the following:

AB29-ASA1,1,10 (a) If the violation is the person's first violation, a Class C misdemeanor.

AB29-ASA1,1,11 (b) If the violation is the person's 2nd violation, a Class B misdemeanor.

AB29-ASA1,2,2 (c) If the violation is the person's 3rd or subsequent violation, a Class A misdemeanor.
