ASSEMBLY AMENDMENT 6, TO 2009 ASSEMBLY BILL 462

AB462-AA6,1,1 At the locations indicated, amend the bill as follows:

AB462-AA6,1,4 1. Page 2, line 2: after "provided" insert ", withholding child care subsidy payments under Wisconsin Works pending a hearing on a matter and limiting the time for making a decision,".

AB462-AA6,1,5 2. Page 21, line 12: after that line insert:

AB462-AA6,1,6 " Section 36p. 49.152 (2) (e) of the statutes is created to read:

AB462-AA6,1,9 49.152 (2) (e) If the department reviews a decision of a Wisconsin Works agency that relates to the child care subsidy program under s. 49.155, all of the following apply:

AB462-AA6,1,11 1. The department may allow the individual who petitioned for the review under this section one or more continuances.

AB462-AA6,2,3 2. If the department grants the individual a 2nd continuance, all child care subsidy payments on behalf of the individual shall be suspended pending the decision of the department.

AB462-AA6,2,6 3. Notwithstanding par. (d), the department shall render its decision within 30 days after receipt of the petition or request under par. (c), regardless of whether the department has granted one or more continuances.".

AB462-AA6,2,8 3. Page 24, line 1: delete "This act" and substitute "Except for the treatment of section 49.152 (2) (e) of the statutes, this act".

AB462-AA6,2,9 4. Page 24, line 7: after that line insert:

AB462-AA6,2,11 "(1d) Wisconsin Shares review. The treatment of section 49.152 (2) (e) of the statutes first applies to reviews requested on the effective date of this subsection.".

AB462-AA6,2,12 5. Page 24, line 13: after that line insert:

AB462-AA6,2,14 "(1d) Wisconsin Shares review. The treatment of section 49.152 (2) (e) of the statutes and Section 40 (1d) of this act take effect on the day after publication.".
