SB181-SSA1-SA1,1,11 At the locations indicated, amend the substitute amendment as follows:
SB181-SSA1-SA1,1,2 21. Page 13, line 24: after that line insert:
SB181-SSA1-SA1,1,3 3" Section 65m. 101.123 (3) (jg) and (jj) of the statutes are created to read:
SB181-SSA1-SA1,1,64 101.123 (3) (jg) Smoking by a resident of a nursing home in an area of the
5nursing home that has been designated as an area where residents may smoke, as
6provided in sub. (3g).
SB181-SSA1-SA1,1,97 (jj) Smoking by a resident of a treatment facility that is primarily engaged in
8providing diagnosis, treatment, or care of persons with mental diseases, as provided
9in sub. (3j).".

1101.123 (3g) Nursing homes. The administrator of a nursing home, as defined
2in s. 50.01 (3), may designate areas of the nursing home, which are away from places
3used for eating, as areas where residents of the nursing home may smoke.
SB181-SSA1-SA1,2,8 4(3j) Treatment facilities for persons with mental diseases. A treatment
5facility that is primarily engaged in providing diagnosis, treatment, or care of
6persons with mental diseases may adopt rules that allow residents of the facility to
7smoke in the facility if the rules provide for protecting the health and comfort of
8others.".
