TO SENATE SUBSTITUTE AMENDMENT 1,
TO 2009 SENATE BILL 264

SB264-SSA1-SA1,1,11 At the locations indicated, amend the substitute amendment as follows:
SB264-SSA1-SA1,1,3 21. Page 1, line 2: delete "and all-terrain vehicles" and substitute ", all-terrain
3vehicles, and other off-highway vehicles".
SB264-SSA1-SA1,1,4 42. Page 1, line 4: before that line insert:
SB264-SSA1-SA1,1,5 5" Section 1g. 23.119 of the statutes is created to read:
SB264-SSA1-SA1,1,6 623.119 Consent to use certain off-highway vehicles. (1) In this section:
SB264-SSA1-SA1,1,77 (a) "All-terrain vehicle" has the meaning given in s. 340.01 (2g).
SB264-SSA1-SA1,1,108 (b) "Off-highway vehicle" means a motor-driven craft or vehicle principally
9manufactured for off-highway use but does not include a snowmobile or all terrain
10vehicle.
SB264-SSA1-SA1,1,1111 (c) "Snowmobile" has the meaning given in s. 340.01 (58a).

1(2) No person may operate an off-highway vehicle on private property without
2the consent of the owner of the property.
SB264-SSA1-SA1,2,5 3(3) No person may operate an off-highway vehicle on public property that is
4posted as closed to the operation of off-highway vehicles or on which the operation
5of an off-highway vehicle is prohibited by law.".

SB264-SSA1-SA1,2,8 8" Section 1t. 350.10 (1) (f) of the statutes is amended to read:
SB264-SSA1-SA1,2,139 350.10 (1) (f) On the private property of another without the consent of the
10owner or lessee. Failure to post private property does not imply consent for
11snowmobile use. Any other motor-driven craft or vehicle principally manufactured
12for off-highway use shall at all times have the consent of the owner before operation
13of such craft or vehicle on private lands.
