SENATE AMENDMENT 5, TO 2009 SENATE BILL 331

November 5, 2009 - Offered by Senators Darling, Lazich, Schultz, Hopper, Kanavas, Kapanke, Grothman, Leibham and Cowles.

SB331-SA5,1,1 At the locations indicated, amend the bill as follows:

SB331-SA5,1,4 1. Page 2, line 2: after "provided" insert "; prohibiting child care subsidy payments under Wisconsin Works for child care provided for a child of an employee of the child care provider;".

SB331-SA5,1,5 2. Page 21, line 12: after that line insert:

SB331-SA5,1,7 " Section 36L. 49.155 (3m) (e) 1. of the statutes, as created by 2009 Wisconsin Act 28, is repealed.

SB331-SA5, s. 36m Section 36m. 49.155 (3m) (e) 2. of the statutes, as created by 2009 Wisconsin Act 28, is renumbered 49.155 (3m) (e) and amended to read:

SB331-SA5,2,2 49.155 (3m) (e) No funds distributed under par. (a) may be used for child care services that are provided for a child by a child care provider who employs either the parent of the child or a person who resides with the child, unless the child care provider is licensed under s. 48.65 and at all times at least 60 percent of the children for whom the child care provider is providing care are qualifying children.

SB331-SA5, s. 36n Section 36n. 49.155 (3m) (e) 3. of the statutes, as created by 2009 Wisconsin Act 28, is repealed.".

SB331-SA5,2,6 3. Page 24, line 1: delete "This act" and substitute "Except for the treatment of section 49.155 (3m) (e) 1., 2., and 3. of the statutes, this act".

SB331-SA5,2,7 4. Page 24, line 7: after that line insert:

SB331-SA5,2,10 "(1c) No child care subsidy for parent who is employed by child's provider. The treatment of section 49.155 (3m) (e) 1., 2., and 3. of the statutes first applies to child care services that are provided on the effective date of this subsection.".

SB331-SA5,2,11 5. Page 24, line 13: after that line insert:

SB331-SA5,2,14 "(1c) No child care subsidy for parent who is employed by child's provider. The treatment of section 49.155 (3m) (e) 1., 2., and 3. of the statutes and Section 40 (1c) of this act take effect on the day after publication.".
