25meal periods under par. (b), within an 8-hour period.

AB524,6,5 3(2) An employer shall provide compensation to a minor employe on a rest period
4under sub. (1) (a) at the applicable rate of pay for the minor employe when the rest
5period occurs.
AB524,6,8 6(3) A meal period under sub. (1) (b) shall commence reasonably close to 6 a.m.,
712 noon, 6 p.m. or 12 midnight or approximately midway of any work period or at
8such other times as may be considered reasonable by the department.
AB524, s. 9 9Section 9. 103.74 (2) of the statutes is amended to read:
AB524,6,1210 103.74 (2) Keep a record for each employed minor of the minor's name, address,
11date of birth, the time of beginning and ending work and the each day, time for meals
12and rest periods each day and the total hours worked each day and each week.
AB524, s. 10 13Section 10. 103.82 (1) (b) of the statutes is amended to read:
AB524,6,1814 103.82 (1) (b) In addition to the penalties provided in par. (a), any employer who
15employs any minor in violation of s. 103.68 or 103.685, or rules of the department
16shall be liable, in addition to the wages paid, to pay to each minor affected, an amount
17equal to twice the regular rate of pay as liquidated damages, for all hours worked in
18violation per day or per week, whichever is greater.

20as renumbered, is amended to read:

AB524, s. 13 25Section 13. 103.937 of the statutes is created to read:

1103.937 Rest and meal periods; migrant workers. (1) An employer of a
2migrant worker shall provide at least all of the following:
AB524,7,43 (a) A 15-minute rest period to the migrant worker for each 4 hours of work, not
4including meal periods under par. (b), within an 8-hour period.
AB524,7,75 (b) A 30-minute meal period, in addition to any rest period under par. (a), to
6the migrant worker if the migrant worker works 6 or more consecutive hours,
7including rest periods.
AB524,7,10 8(2) An employer shall provide compensation to a migrant worker on a rest
9period under sub. (1) (a) at the applicable rate of pay for the migrant worker when
10the rest period occurs.
AB524, s. 14 11Section 14. 109.09 (1) of the statutes is amended to read:
AB524,8,712 109.09 (1) The department shall investigate and attempt equitably to adjust
13controversies between employers and employes as to alleged wage claims. The
14department may receive and investigate any wage claim which is filed with the
15department, or received by the department under s. 109.10 (4), no later than 2 years
16after the date the wages are due. The department may, after receiving a wage claim,
17investigate any wages due from the employer against whom the claim is filed to any
18employe during the period commencing 2 years before the date the claim is filed. The
19department shall enforce this chapter and ss. 66.293, 103.02, 103.023, 103.49,
20103.82, 103.93 to 103.937 and 104.12. In pursuance of this duty, the department may
21sue the employer on behalf of the employe to collect any wage claim or wage
22deficiency and ss. 109.03 (6) and 109.11 (2) and (3) shall apply to such actions. Except
23for actions under s. 109.10, the department may refer such an action to the district
24attorney of the county in which the violation occurs for prosecution and collection and
25the district attorney shall commence an action in the circuit court having appropriate

1jurisdiction. Any number of wage claims or wage deficiencies against the same
2employer may be joined in a single proceeding, but the court may order separate
3trials or hearings. In actions that are referred to a district attorney under this
4subsection, any taxable costs recovered by the district attorney shall be paid into the
5general fund of the county in which the violation occurs and used by that county to
6meet its financial responsibility under s. 978.13 (2) for the operation of the office of
7the district attorney who prosecuted the action.
