The Honorable, The Senate:
Pursuant to Chapter 109 of Wisconsin Statutes I hereby submit the department's 1997 annual report on business closings and/or mass layoffs to you. This report lists all businesses which notified the department in 1997 of planned closings/mass layoffs and complaints the department received of alleged notification infractions. The report indicates the business involved, location, date complaint received, determination issued and disposition of each complaint. Beyond complaints filed in 1997, the list updates the disposition of complaints pending at the end of 1996 or filed early in 1998.
Nine 1996 plant closing complaint remained under investigation at the beginning of 1997. The department settled one violation by collecting $147,000 in penalty wage and a $30,000 surcharge. Three cases are currently at the Department of Justice pending litigation of violations. The department found no violations in four other cases and one case remains under investigation at this time.
The department received 22 complaints in 1997 and one complaint so far in 1998. The department completed 17 investigations of 1997 complaints finding violations in three cases and no violations in 14. The remaining five 1997 cases and the one 1998 case remain under investigation at this time.
